It has been a while since TheEye has blogged, but we couldnt resist commenting on the denouement of the USAPA saga.

We encourage all US Airways and American pilots to read Judge Silvers final Order. Contrary to what Hummel and the BPR is spouting off to the east membership, it's clear that Judge Silver completely neutered USAPA. Her ruling effectively ended USAPAs participation in the upcoming seniority list integration with American. If this reality hasnt sunk in yet, we suggest you actually read Judge Silvers Order. You will read that USAPA waived their right to participate in the McCaskill-Bond process with the ratification of the MOU which requires the Allied Pilots Association (APA) to file for single carrier status within four months of the merger.

Silver stated:

As contemplated by the MOU, in the very near future an election will take place and a new representative will be chosen by all the post-merger pilots. It is almost certain USAPA will lose that election. Once that happens, USAPA will no longer be entitled to participate in the seniority integration.

With this in mind, it's laughable that the USAPA Merger Committee believes that they have any meaningful purpose. Apparently, they missed APA's filings with the NMB a few weeks ago seeking a single carrier declaration. TheEyes legal consultants believe that the NMB could rule as soon as March on the single carrier question. At that point USAPA and any other challengers will have thirty days to submit cards to force an election. At the end of thirty days (sometime in April) the APA will be the bargaining agent for all US Airways and American Airlines pilots.

We know this is contrary to what the USAPA leadership has been telling you, but rest assured, they are wrong. We had to laugh when we heard Steve Bradford telling pilots in the crew room that he believes there will be an election as many APA pilots are dissatisfied with their union.

Amazing Steve - did you not read Silvers Order where she gave the keys to the seniority integration to the APA?

The end of USAPA is almost upon us. Once they are gone, the APA will be responsible for establishing a fair process to integrate the East, West, and American lists.

I didn't see anything in his letter that said he required west participation.  I'm sure he'd prefer it, but I doubt he'll accept just anybody from the west.  They'll need to accept USAPA's goal of representing ALL of its pilots, not just the westies.

Well let us talk about hilarious! 767JETZ is in class as a WEST pilot apparently his predictions after leaving with ALPA didn't work out at CAL and now he feels he will get his (NIC) and be better off at AA! See all along he was a WEST pilot sorta like DCA319 pretending to be neutral, but hey on to better things ! Bottom line the WEST will be represented by USAPA plain and simple, NO NIC, voted away DOA! RIP! Trash talk all you want, the court is your next option, let us go there!

I'd have assumed some fresh-baked cookies and milk would be needed as well....and you left out the part about artificially elevating "you'se" seniority so's to allow jumping ahead of others with 10+ more worked years than yourself, that actually EARNED it, and all for the most noble and "Integrity"-laden reasons of course, because after all, you're just that kinda' truly righteous guy...?
