You westholes (and you are an honorary one, especially the "hole" part) keep bringing this up like it makes any difference to the east pilots.

My answer: SO WHAT?
Traitor has absolutely no standing in his peer group.

Silver gave you scab pricks a Colombian neck tie. You're already completely ignored. Your Billion dollar experiment that flushed a third of your career down the toilet was an epic failure. Whose "We"? What's "USAPA"? Is PHL threatening to leave behind DCA? Is DCA threatening to move on without CLT?

Absurd. The very-soon-to-be former bargaining agent USCABA has ALREADY been relegated to a position of supreme worthlessness. The money they have extorted will be forcibly returned to its owner and the two dozen or so "founding scab Asssholes" that dreamt up this abortion will likely be personally sued in virtually every state of the union for years. Personal Bankruptcy until death. Will any of the plaintiffs have a case? Let's ask 50 judges of 50 states that question for the next 20 years to find out.
Why waste all that time, just appeal judge SILVER's ruling to the 9th and ask for clarification. And why your at it ask for clarification on that career thing!

Does anyone know if the West met their deadline to appeal their loss of the DFR lawsuit?  Should we have heard about it by now.. I thought they only had 30 days?

Isn't that what we told Nicolau when he said we weren't getting DOH and to seriously reconsider our position?

Usapa can't move on with or without the west. The company and its counsel, and the APA and its counsel have got our number. The APA and the company will figure out for themselves where the potential land mines lay, and act accordingly.
And there won't be any RICO retribution. Nobody will fund it on their own. Unless someone has 500 grand a month coming in and their own lawyer with no oversight to do the dirty work.
I agree that the company and the APA could and should crush USAPA. I certainly understand your thinking as a Cactus 18er. I've been watching the conversation on the AWAPPA boards as well as Usapians and management who have been given access. They know what's being talked about and are anticipating further litigation. That's why they are "touchy" and crabby. 😉

Conversation along these lines:

Can we file a law suit against Bradford for starting all of this mess?!

Anybody can file a lawsuit for anything. Ask the Cactus 18...
Yep, merit is not a requirement for filing a lawsuit. All you need is money, and a willingness to spend it.

1. I say we all file small claims cases against these pricks
In for small claims. They should at least have to answer for this.

I'm in for small claims as well... For 50 bucks, I'll even be the guinnie pig to see how long it takes...

First, unions are subject to personal jurisdiction in every state in which its members reside. So - they are free to ignore service if they wish - and in fact that would be great - because then the court could issue a default judgment against them. Second, the small claims court has subject matter jurisdiction because the dispute is with regard to the union's constitution, which is a common law contract between the union and its members. If a union breaches its constitution, it is actionable in state court just as is any other contract. Third, you can fill out a small claims lawsuit in Maricopa County online. It doesn't require going down to the courthouse until the court date.

1. took ALPA to small claims court over a $1500 bill they sent me for monies I owed four years previous. They miraculously found this 30 days after AWAPA ( not the web board) came out publicly. They threatened to sectioned 29 and I ran to small claims. Unfortunetely I had to pay those f$%kwads at national before I could sue. Then I forced them to spend around $2500 defending themselves. In Scottsdale you do have to pay first but they will have to defend themselves. The whole thing costed me $16. and one morning at court. And the bonus? I got to state in open court how despicable and dishonest ALPA National was.
Short of SMALL CLAIMS COURT (next step), I don't know how to get any resolve from
these A$$wipes (USAPA).

Bottom line, anybody can file a lawsuit against USAPA for $50-$70.

For example, if someone is staying at the CLT Uptown can walk a block and file to dispute a billing statement.

It certainly is their right.

Why don't you take up the AirTran pilots cause. Ask them how they got the LUV shown to them. The america west pilots are getting very fair treatment.

Bradford is a visionary. USAPA should commission a statue of the Founder for placement in the Carolina's Air Museum.
