How about bringing this to a court of law, your west pilot group has not hesitated before with the legal briefs?

"Here is a little behind the scenes look at the latest BPR Meeting that they either can't or won't give you because of constraints on what they can tell you. 
 
First off, the latest west BPR Reps continue to act as immature children and will do anything and everything they can to continually disrupt the meetings.  For instance, in a serious discussion with the attorney's about important items they are discussing, a west rep will interrupt by asking "How do we get out of this @#&%$ union?  It is no small wonder that at least one, if not all of the east reps don't take one or all three of these guys out to have a "Parking Lot attitude change."  Their restraint is commendable.
 
If we have learned nothing else in this unfortunate experience with the west is that many do not deserve to be labeled Professional Pilots.  What they are is small minded children with a inferiority complex that shows itself at every opportunity.
 
Just to give you another example, since they have won NOTHING the last 4 times they have been in court, they are now resorting to threats that they will sue every BPR member that has ever served representing the east.  They continue to exhibit a maturity level of someone that is about seven and yet they think they are "winning" the battle.  Instead, it reinforces in everyone that associates with them that they can never be held in anything but the lowest esteem.
 
More background on the latest Grievance we have "won."  The Grievance Committee was forced to negotiate the grievances that we thought we had agreed to when we negotiated the MOU the first time.  Let me make sure you understand this.  The so called Corporate Culture that Parker and Kirby claim they want has us as "B" scale pilots making less money than the American pilots and when we negotiated the MOU and thought we were getting equal pay for equal work, it never happened.  In a nut shell, we were forced to negotiate once again the same items we negotiated once before and thought we got.  But are we getting those agreed to items?  Maybe eventually since the company will not tell us when, if ever they will agree honor the agreement.  There is certainly zero chance they will pay us the back wages that we should get.  But I find it interesting that the company will go to great expense to make sure the American Pilots receive what they negotiated, but spend little to make sure we get what is due us.  Where would all these people be today without the east pilot's sacrifice?  That question has yet to be asked or answered.
 
That is what happens when you agree to an open ended MOU where many of the items those of us that objected to the MOU as it was negotiated by Gary Hummel tried to warn you about.  How many thousands of dollars will each of us not be paid is a good question?  The "New American" just made record profits this last quarter once again on the backs of the east pilots.
 
The BPR had to make a decision.  Vote against this agreed to grievance and hope some day we get what was promised or go to arbitration and hope for the best.  The Grievance Committee Chairman Dave Ciabattoni recommended they vote for it, so with noses held, they did.
 
I wish we had a Union President that had the guts to stand up to Parker and Kirby in public and demand an explanation into their conduct as regards the new Corporate Culture.  But that would be totally out of character for Gary.  Enough said about that for now.
 
After the last vote, I am convinced more than ever that apathy here is the biggest problem.  Too many pilots do not take the time or expend the energy to keep up to date on important issues.  I had pilots ask me what that issue was all about in the last pilot vote and when told, they were hoping for another chance to vote since they didn't vote the first time.  It is so frustrating that these issues go under their radar because they are too lazy to look up to see what is happening.  But we get what we deserve when that happens.
 
Not withstanding the West BPR Reps, we have a great bunch of east reps and they are doing their best to guide this union with little or no recognition for how much they do and how much they sacrifice of their time and money.  They are rarely given Flight Pay Loss and often lose money by doing union work.  I salute them, past and present."

It has recently come to my attention than an east pilot, Bill Glynn, has sent out an email that one could construe as advocating violence specifically against west representatives.  I have had the opportunity to read the email and do agree that it does contain a message of violence in the following statement:

Having recently acted as a Duely Designated Representative for one of our elected pilots, I no longer feel comfortable attending meeting in CLT for fear of an “attitude change” if I speak my mind on behalf of the west pilot group.
 
Since can’t speak on Bill’s behalf as to whether he’s merely pointing out the fact that the east representatives have not acted physically against the west representatives or if he’s sending a message that they should consider doing so,  I would consider investigating Bill’s intent and logic for sending such an email.

Upon information and belief, a “blanket party” refers to a method of assault in which attackers restrain and blind their victim by throwing a blanket over the victim’s head, and then strike the victim repeatedly. The same pilot has been subjected to the threat of a concerted effort by multiple pilots to put him on a “no fly” list in order to severely limit or eliminate his work opportunities.
 
78. On or about May 9, 2008, a doll with “USAPA” written on it was discovered hanging from a noose inside the cockpit of a US Airways aircraft that landed at Lambert Airport in St. Louis, Missouri.
 
79. On or about, 20April 2008, a box of envelopes containing feces being sent through the mail to USAPA’s post office 08, the U.S. Postal Service informed USAPA that injurious articles, including rocks, have been sent through the mail addressed to USAPA’s post office box.  Upon information and belief, such mailings were made with intent to injure other persons, the mails or other property. The mailing of such nonmailable matter violates 18 U.S.C. § 1716, and subjects the person(s) responsible to fine or imprisonment of not more than
twenty years, or both. The U.S. Postal Service has requested USAPA’s assistance in identifying the responsible parties and putting an end to this unlawful conduct. Upon information and belief, one or more of the defendants or their co-conspirators are responsible for this conduct."
 
 
On or about April 22, 2008, defendant McIlvenna (former america west pilot alpa union mec leader) using electronic communication, threatened the safety of a US Airways pilot by stating that “I hope the pilot group does not know about your plan to pay USAPA dues and join as a member, else I fear for your safety.” Defendant McIlvenna is a member of the Board of Directors of AWAPPA.

"Essentially the west just wants to be treated fairly and USAPA has not done this.   And now that they are about to be dissolved they are trying to throw one more monkey wrench into the machinery.  They have pulled out if talks with APA.

Jurik is angry over his situation on Ashurst. He needs to seek professional credit counseling. He should stop listening to identified liars such as Mark Doyal.
The APA should watch you goons like a hawk. Isn't Compass Correction an East pilot website? How about USAPAwatch? There is such a tangled web of lies even your own people can't keep up with the deception.

Mission Statement

We, the writers and editors of The Compass Correction Card firmly believe that you, the Real Directors of USAPA must make informed decisions and that you can be inspired to actively engage our union representatives and leaders, with pointed and thoughtful questions. Only then will the pilots be able to make informed decisions as we work our way towards a consensus.

Compass Correction:

We have read with a combination of alarm and amusement, the electronic newsletter from USAPA, The Iron Compass. We are disappointed by the highly politicized and biased tone of its writers. The articles that we have read thus far play fast and loose with the facts. They have twisted real events into propaganda for the benefit of our current administration seeking centralized power with less accountability. The current USAPA Communications Policy neither invites nor even tolerates opposing viewpoints. The Administrations communication /political strategy depend upon the suppression of contradictory and questioning voices. Have you ever wondered why our Current President ran as a part of a Slate?; quite simply, because propaganda can only succeed in a vacuum of competing ideas and with a lack of loyal opposition to a dictatorial style. Sunshine remains the best disinfectant.

THE ISSUES OF THE DAY:

In this first outreach, we will address a couple of issues. The most pressing and egregious is the deliberate and ongoing misrepresentation of former Executive Vice President Dave Ciabattonis position of record on the retention or elimination of the office of EVP at USAPA. Efforts by the Former EVP to have USAPA communications corrected resulted in, initially no response from USAPA, followed by further misrepresentation of Ciabattonis position on the subject of the office of Executive Vice President.

A full court press to get the vote out is being waged by USAPAs P4P program. Talking points include (an imaginary) - $100,000 savings per year, and false assertions by USAPA that the former EVP had actually recommended the wholesale elimination of the position when he has not done so. If youre more interested in the options presented, in context, contact your domicile representative.

It is a certainty that, in the absence of an EVP, that much of his former work will be then allocated to ad-hoc committees. This is true, because historically, our current President and Vice President are work aversesad, but demonstrably true.

By the Constitution the President has the sole power to appoint these ad hoc committees. To what cost will flight pay loss rise in order to accommodate the presidents handpicked ad hoc committee members?

The former EVP presented in writing a number of Options to the BPR on November 3, 2009 regarding the staffing needs for USAPA. One of many options presented to the BPR was the replacement of the EVP with an in-house attorney/contract administrator (option G).

When our former EVP brought the current misrepresentation of his position to our Communications Committee Chairman the resulting correction was nearly hidden within the Iron Compass. The correction was minuscule, misleading and missed the pointotherwise, it was fine!

Why is it so important for USAPA leadership to eliminate the EVP position which was addressed in the USAPA Constitution referendum of October 2008 that they resort to misrepresenting the former EVPs position?

What you see below, in italics, is excerpted from USAPAs website. It was intended to be a sort of FAQ to our line pilots. In fact, it turns out to be simply more misleading propaganda.

{The Board in fact decided, after carefully weighing the facts (including the former EVPs recommendation of several staffing options including the elimination of the EVP position), to endorse elimination of the EVP position. Further, there is no such consolidation by eliminating the EVP position. USAPAs Constitution clearly states that the EVP duties are at the direction of the President. Should these administrative tasks be assigned to a staff member, they will still operate at the direction of the President. Further, the President does not even have a vote at the table. It is the line pilots that control the direction of their Union, through their Reps.}

In reference to the talking point above put out by USAPA Communications, it appears the communication policy is to mislead the line pilots, in order to push a political agenda.

The truth of the matter is USAPAs President DOES have a vote at the table, every time there is a tied vote among the Board.

Mr. Cleary and Mr. Theuer are well aware of that fact. Mr. Cleary used that very power in October, 2009 when the BPR was split on a very contentious vote over USAPAs sexual harassment policy. Mr. Cleary proposed to put himself and Randy Mowrey, the vice-president, in charge of being the "gate keepers" of what was to be considered sexual harassment and what was not. Mr. Cleary cast the tie-breaking vote to pass this particular resolution; an obvious conflict of interest, wouldnt you say?

In this instance, fortunately for us all and after some soul searching, a majority of the BPR members overturned the vote the next day. We can infer from this that Mr. Cleary is not interested in consensus, and will use his tie-breaking vote whenever it suits his political agenda. This talking point, put out by USAPA, on the lack of Presidential voting power is an outright deception for a reason we can only speculate upon.

Our USAPA Communication Chairman's attitude and job performance is indicative of his "old-school ALPA Iron Compass mentality. Perhaps he should remember that only when an inexperienced pilot needed the iron compass, he had to stop looking forward and start looking straight down to keep over the tracks. Not seeing what was coming ahead often resulted in flight into an obstacle that a pilot who had planned ahead, would have avoided. Iron Compass...more like an Iron Curtain of USAPA.

One of the reasons we got rid of ALPA was their tendency to manipulate? If this issue seems to be of little importance to you, ask yourself this question instead; if USAPA is willing to misrepresent this issue, then what else have they, or will they misrepresent next?

It is our recommendation that every Pilot vote to retain the position of EVP within USAPA. More oversight and division of power within the Officer ranks and not less is whats need now. If youve already voted its not too late to change.

On Tuesday February 7th, USAPA EVP, Gary Hummel was summoned to Mike Clearys office, ostensibly to discuss a technical problem that developed with the conference call system in the USAPA offices. This glitch occurred during a P4P call a few days prior. The details are not important, since the premise of Mikes call for Hummel to appear, was a false one, as you will see shortly.
As an interesting aside to the story; Hummel had been working through the vendor to correct the technical glitch for some time, but had been told by an office staffer,Natashia Lyndsey, that this was her responsibility, and to stop working on it.
At any rate, when Gary walked into the February 7th meeting, called by Cleary,he perceived an acrimonious atmosphere, as both Natashia and Randy Mowrey were present. Based on numerous bushwack meeting tactics Mike had used on Gary, and former EVP, Ciabattoni in the past, Hummel invited Sec./Treasurer Rob Streble into the meeting as his witness.
Mike Cleary insisted that Rob leave the room. Gary then stated that if Rob had to leave, he too, was leaving. Rob was ordered out of the room, and Gary left with him.
Very shortly thereafter, at 3:54 PM Mike sent an email , (clearly tagged as Confidential) - to the BPR. In the email, (see attached below) Cleary dramatically altered, (readlied about) - the events of the evening. The time stamp for this email is below. The content is available if you need it.

Later that same day, Bill Glynn sent out the following email to his yahoo distribution list. This has had the effect of accomplishing Mikes objective; to falsely slander Gary Hummel. Glynn even took the trouble to elaborate and embellish on Mikes defamatory message.
Bill is clearly participating in the many deceptions of this Cleary-instigated subterfuge, by falsely stating that he, (Glynn) received it from a USAPA Board member. By this false attribution, Glynn may have intended to imply that a Board Member had a grudge against Hummel. In any case, the source was Cleary and the conduit was Bill Glynn.
Any other speculation is merely a distraction; the fact is, President Cleary is willing to lie , as is Bill Glynn,to affect the voting in a union election. Glynn and Cleary conspired to set the fire and then blame it on someone else. We have seen this playbook before from Cleary; most recently in Mikes outrageous slander of Attorney Lee Seham. We should not be surprised.

I received this letter from a USAPA Board member. He sent it to me to
illustrate the problems they are having with Gary Hummel. He is increasingly
unresponsive to the Boards requests and the other officers.
He told me that the Board members are finding it increasingly difficult to
work with Gary to do USAPAs business. If this is what we can expect for
the future with Gary Hummel as the President, I fear we will just see
politics as usual. Nothing will get done and instead of trying to find common
ground to work together, well find a dysfunctional USAPA.
Leadership is about bringing different peoples together for the common
good of everyone. Antagonizing people you work with is not leadership.

This is not the biggest lie in Mike Clearys Big Lie campaign, just the latest. The biggestlie is the false assertion that Gary is conspiring with the West Pilots to somehow bypass the court proceedings in PHX, ignore our Constitution and By Laws, dismiss the will of the entire BPR, and finally, that Gary Hummel could, or would negate the ratification voting power of the entire pilot group. In the end, it will be the majority vote of the Line Pilots which determines whether or not the Nicolau Award becomes part of ourcontract.It is hard to decide which is more outrageous; the lie itself, or the fact that Mike Cleary once again fed his lies, through Bill Glynn and his distribution list by claiming that he heard a conversation between Gary and the PHX reps through a hotel wall. Any rational person would be too embarrassed to admit they listen to private conversations through hotel walls. ...and now we have a West individual obsessing to find examples of East individuals that misrepresent facts....

Yes, Snap has volunteered to be the prime suspect, and it doesn't take the FBI to see the obvious... Even a graduate of a public school system can see through that accidental confession... But evidently a graduate of private schools sees all misrepresentations as equal---whether they are an email to a boss, or rag journalism to sycophants.

The obsession screams the evidence... My apologies to public school graduates everywhere that would have indeed been hired by the FBI as analysts, if only they had just blessed them with an application.

Motions, Resolutions, and Votes in this Recap are not official until Meeting Minutes are approved.
In accordance with the USAPA Constitution and Bylaws Article 5, Section 3 C; and the Union Operating Manual Section 3 III; the Board of Pilot Representatives Special Meeting from April 23, 2014 resumed by telephone conference call Monday, April 28, 2014, at 19:00 EDT. The agenda remained as previously approved by the Board. The Officers, Board of Pilot Representatives, Merger Committee, Merger Counsel Pat Szymanski, General Counsel Brian O'Dwyer, and Communications were on the call. PHL Vice Chairman John Taylor joined the call at approximately 19:25.
At approximately 19:03, President Gary Hummel called the meeting to order. He then turned the Chair over to VP Steve Bradford, since Steve had chaired the previous days of this special meeting. Steve briefly introduced the documents before the Board (the proposed Protocol Agreement, proposed Union Merger Transition Agreement, and proposed Global Settlement Agreement) and asked the Board to limit comments to 5 minutes at a time.
At approximately 19:08, a motion to accept the proposed Protocol Agreement, which was previously sent to the Board by the Merger Committee, was moved/seconded by Stein/Dugstad.
After brief discussion, a motion to go into closed session was moved/seconded by Dugstad/Nelson and passed 6-4 (Yes - DCA, CLT, PHL Music; No - PHX, PHL DiOrio).
At approximately 21:17, the Board returned to open session, and after an editorial change, the following resolution passed 7-4 (Yes - PHL, DCA, CLT Borman, Nelson; No - PHX, CLT Frear).
Merger Documents
BE IT RESOLVED THAT the Board of Pilot Representatives approves the proposed Protocol Agreement and Settlement Agreement as presented by the Merger Committee,
BE IT FINALLY RESOLVED THAT the Board of Pilot Representatives approves the proposed Merger Transition Agreement as amended.
President Gary Hummel then brought before the Board the urgent need for a Consultant Contract for Dr. Pete Lambrou, AME, to assist the Safety and Accident Investigation Committees, relating to the current investigation of the PHL rejected takeoff.
At approximately 21:23, a motion to go into closed session was moved/seconded by Scherff/Ferguson and passed unanimously. After approximately 10 minutes, the Board returned to open session and discussed provisions of the consultant contract.
A motion to approve the following resolution was moved/seconded by Taylor/Nelson.
Dr. Pete Lambrou
BE IT RESOLVED THAT the Board of Pilot Representatives directs the Consulting Contract for Dr. Pete Lambrou be amended to place a $40,000 limit, to be monitored by the Executive Vice President, and any additional expenditures to be approved by the Board of Pilot Representatives.
Before the vote was completed, the call system terminated the call at 22:00.

Imagine that, the call system technology overcame the ability to vote on a motion... having witnessed the use of these systems extensively myself, I completely understand the buffoonery that can happen when the scheduled call time is up, but it is hilarious none the less.

I don't think the Westies are going to be happy with the Protocol Agreement, Global settlement or amended MTA.. It's going to be a long week in PHX trying to keep the faithful inline.

Soooo.... either negations with the APA are continuing and there is just about nothing to report, and the BPR will receive an update about nothing, or a watershed agreement is on the verge of being approved, the BPR is familiar, and is about to get on board...

At approximately 19:08, a motion to accept the proposed Protocol Agreement, which was previously sent to the Board by the Merger Committee, was moved/seconded by Stein/Dugstad.

Is this not good news? It seems that a Protocol Agreement, and a Settlement Agreement (drops the lawsuit?) and a Merger Transition Agreement have all been approved between USAPA and APA. Time to move forward; finally!
