AMFA DEAL TO END STRIKE

I found this comment on another site. I thought it interesting enough to share it with you. Your thoughts please....

Basically, as I remember, the court ruled that that when a scab is hired in as a "permanent replacement" it is illegal for a company to lay them off or terminate them, regardless of seniority standing.
That decision set the labor movement back 40 years or more and since Reagan glorified scabs in the PATCO strike, which made companys feel better about hiring scabs, the right to strike has become more of a tool for companys than union workers.

there's some laws and stipulation on this if I remember... company must show some kind of economic hardship or some nonsense...then they can state "premament replacements"

it is illegal for government workers to go on strike.... if I remember right (phhhhhht why?)

and USUALLY scabs are gone in most cases, if they are hired as replacements during the strike. "Permament replacements" might have been a name coined from NW management in order to say that they are, if they really are or not I don't know. Now with that said and done, I'm sure the koolaid drinkers forum will harp and hype that they are replaced, yada yada yada and who cares. I'm waiting for what unfolds.


I dunno about smart, but my Big Daddy calcuated that NW is going to make off with at least a good several thousand dollars PER MX with this deal, he feels that is not fair for them to ream everyone like that so he is voting no. Even stated that Vacation pay is paid out 24 bucks an hr (or whatever the scab wage is) also.

Yesterday a troop of those 😛h34r: enplaned on my flight. All getting some kind of demonstration on some contraption. OOOOOOOOHH AHHHHHH.
No one gave a rats arse about the two lavs inop, cabin smelling like pee and rotten fish. It was funny, this must have been going on for a while since the floor was littered with coffee..... :lol: Welcome to the NEW NW!

I am having a hard time with this t/a basically because it is asking you to vote for severance and/or lay-off. It allows you to vote if you want flight bennies, your accrued vaca pay, etc...But what it doesn't say is how many people NW plans to re-hire, where, when, etc...When you get right down to it, this contract isn't even about jobs. Why did we go on strike?

Voting "Yes" is the same as saying that you were wrong to strike in the first place.

Keep the strike in effect.

By voting "Yes" you will be personally validating the NWAs CEOs sentiment back in 2000 when he said that you mechanics need to "know your place" in society.

The scabs are more than likely "at-will" workers. That means that they can quit at will and the company can fire them at will.

Machinists v. Wisconsin Employment Relations Comm'n, 427 U.S. 132, 96 S.Ct. 2548, 49 L.Ed.2d 396 (1976), holds that states are forbidden to regulate on any subject that federal labor law reserves for the play of economic forces. Under federal labor law, just as workers are free to withhold their labor, so employers are free to hire either temporary or permanent replacements-though employers can't give them superseniority.

So even if they cant technically "fire" them, they can lay them all off and take back all the AMFA strikers first.They would be eligible for recall but their seniority date would be junior to all the AMFA guys.Thats why NWA inserted the language that says there will be no flush. Without that language NWA would have to lay off all the scabs and offer all AMFA members, by seniority, the jobs.

I forgot about the "Coffee" trick. That was only suppose to be a one time shot. When you got to the hub, the cleaning crew went into action. Sounds like the Coffee routine lasts all week? Month? :down:

However, IF this TA somehow gets passed, think about this RWU41...

Anyone currently on strike that is willing to come back to NW will be put on a recall list, and as positions become available they will be called back in seniority order. Lets say that NW decides that they want to ramp up the mechanic headcount for the holiday season, and they recall 300 technicians...Oops, suddenly there isn't enough in the budget for these extra people on the payroll, and NW has to layoff those 300 positions. Guess who will get the axe? That's right - the lowest 300 on the seniority list (most if not all with 2005 or 2006 seniority)!

Now lets say that NW decides to bring back a check line and do the work in house, because they realize that the vendor shop work is substandard. 350 more technicians are recalled for this...Uh oh, some new strain of SARS is discovered and NW comes up with another Force Majeure layoff to shut down their check line. This time, the next lowest 350 mechanics will receive layoff notices (which should take care of most of the SCABS who came back off of layoff status to cross our picket lines).

Are you getting the point, RWU41? NW will have no use for SCABS like you if the strike is somehow settled. You are nothing more than a liability to them, and will soon find out that any promises NW made to you were hollow. For your sake, you better hope that this TA gets voted down. Have a nice day! 🙂

😀.Last response, just can not help it. Look at what nwa replaced us with. Can you make any sense out of what this idiot has written here? The pilots got to love these idiots. I suppose this is another 140 IQ scab. How did he make it through grade school let alone A & P school. No wonder we get no respect in this field. I feel for my union brothers who will return to this mess if this passes. No way I could do it. This is an accident waiting to happen.
