Today is an historic day. Both companies have realized they can announce there are fewer issues to negotiate now that all employees can get Obamacare.

Its a new paint scheme announcement. Texas was apparently very unhappy with the New American paint job. At least that makes as much sense as TX joining the lawsuit in the first place! RR
 
You are not the only West Class member who's favorite memories stop at Wake. I can see why. Let me be clear what I read as the case law. Nothing anyone said or did prior to being certified means anyting in a court of law. Why? Because a vote was taken according to NMB procedures, and no court will ever speak or try to speak to the mind set of over 5000 individuals. Once they vote, majority rules, and its a clean slate. So tell Marty once again, as Silver has numerous times, the events surrounding the creation of USAPA have no bearing on the question at hand, a DFR as to the MOU. And is this a new spin... "purposefully" harmful? Tell Marty to take all the time he want with illuminations. It will be time wasted to the benefit of USAPA. RR

Texas Attorney General Greg Abbott to pull Texas out of US Airways-American Airlines lawsuit?

Texas Attorney General Greg Abbott may announce Tuesday that Texas is now longer part of the U.S. Department of Justice to block the US Airways-American Airlines lawsuit.


He had joined DOJ, five other attorneys general and the District of Columbia in opposing the merger when it was filed Aug. 13, even American is headquartered in Fort Worth, employs tens of thousands in Texas, has its biggest hub at Dallas/Fort Worth International Airport and has a major maintenance base at D/FW Airport.


Abbott, US Airways and American announced a 2 p.m. press conference at D/FW Airport to “announce an important development related to the merger of the two airlines.:


One source said the news conference will be to announce Texas’ withdrawal.

At the moment, we have the original plaintiff states (minus Texas, presumably) — Arizona, Florida, Virginia, Pennsylvania and Tennessee — and late addition Michigan, plus the District of Columbia and the U.S. Department of Justice.

He made a big political mistake.

Tom Horne is geting the same message. I expect AZ may follow.
 
From today's update.

"Finally, should a settlement be reached with the DOJ, there is a 60-day subsequent public comment period. The Company can, and they have indicated they intend to, proceed with the merger without delay during that 60-day period."

Kollar-Kottaly has denied the DOJ request for a stay. Trial goes forward. From the USAPA update:

This morning, October 1, the DOJ filed a request to stay, or pause the lawsuit proceedings until such time Congress appropriates funds. In the motion (click here to view), the DOJ acknowledges that American and US Airways object to the motion. The DOJ said if the Judge ordered them to proceed they will consider it an order from her and they will proceed.

USAPA President Gary Hummel and USAPA General Counsel Brian O’Dwyer were in Washington, DC this morning for the Scheduling Conference regarding the DOJ lawsuit. In a hearing prior to the conference, Judge Colleen Kollar-Kotelly denied the DOJ’s request to stay the case. The Judge indicated she is aware of the merger expiration deadline of January 18, 2014 and will do her best to render a decision prior to that time. The trial will proceed as planned beginning on November 25, 2013.

On Thursday, October 3, USAPA attorneys, along with attorneys from all of the labor groups at US Airways and American, will attend a meeting with the Company’s Antitrust lawyers. This will be a briefing as well as a strategy session where they will discuss any request for future union involvement opposing the DOJ lawsuit.

Finally, should a settlement be reached with the DOJ, there is a 60-day subsequent public comment period. The Company can, and they have indicated they intend to, proceed with the merger without delay during that 60-day period.

Story updated to say that U.S. District Court judge denies Justice Department request for a stay in merger hearing.

CHARLOTTE, N.C. (TheStreet) -- The U.S. Justice Department lost two battles Tuesday in its effort to prevent a merger between American (AAMRQ) and US Airways (LCC_).
The department lost the support of Greg Abbott, Texas attorney general, for its lawsuit opposing the merger, sources said. Also, a U.S. District Court judge denied the DOJ's effort to delay the scheduled Nov. 25 trial date.

The airlines and Abbott scheduled a joint announcement for 3 p.m. EDT at Dallas/Fort Worth International Airport. They promised "an important development related to the merger of the two airlines." Abbott will withdraw his support for the Justice Department lawsuit opposing the merger, sources said. He will appear with American CEO Tom Horton at the news conference.
Additionally, U.S. District Court Judge Colleen Kollar-Kotelly quickly rejected the department's request to stay the case.
The Justice Department reacted quickly on Tuesday morning to the government shutdown, saying it needs more time to prepare for a U.S. District Court hearing on its lawsuit opposing the merger.
But in a hearing prior to the conference, Kollar-Kotelly "indicated she is aware of the merger expiration deadline of January 18, 2014 and will do her best to render a decision prior to that time," according to a newsletter for US Airways pilots issued by their union, the U.S. Airline Pilots Association.
The Justice Department had argued that the shutdown "is creating difficulties for the department to perform the functions necessary to support its litigation efforts and, accordingly, the department's policy is to seek a stay in all pending civil litigation."
In mid-afternoon trading US Airways shares were up 68 cents to $19.64
