Silver is walking a dangerous path. How Harper can continue to steal the West pilots money, knowing fully you cannot have harm until damage is done is stunning. How do you sue another driver for an accident before the accident happens? This is the basic premise Harper just cannot get through his greedy head. Meanwhile Cactusboy and the other incompetent PHX leaders keep the cash flow going to Polsinelli. Unbelievable.
You really shouldn't worry about how we spend our monies. Do we lecture you on you spending your hard earned LOA 93 wages on the SnapBack, Pension Investigation, & the fabled 3%?

Their references to our donations to the legal fund are most telling. They can't mask their concern. West pilots will fund their defense as long as it takes.

Here's more bad news for them. Leonidas has shifted from a tier based donation strategy to a long-term approach. Members are signing up for a monthly donation schedule where payments are automatic.

Whether of not the merger goes forward, West pilots' interests will be represented by Leonidas. Our legal team was here before She-man-ski and will be here after the USAPA problem has been eliminated.

You do realize that the company will not accept a list which violates the TA/CBA they are legally required to abide by, right? You do realize that the NMB parked negotiations pending the outcome in federal court, right? You also realize USAPA could end the whole dispute by accepting the NIC, right?

Some of those donations will be necessary to answer the Motion To Reconsider filed on 5 Sep.

USAPA has challenged Judge Silver's Constitutional Jurisdiction, they have shown her how she has circumvented their earlier objections to her jurisdiction, and they have pointed out how many other judges have properly found lack of jurisdiction (however she has as yet failed to show equal acumen). IMHO the Motion to Reconsider is nearly a rebuke, not in its tone but in its comprehensive demonstration of her failures and errors to date.

It will be interesting to see what Judge Silver does with the pointed clarity about Article III jurisdiction. Brushing past the issue on the 15th Aug was maybe, possibly, (but not really), excusable... To do so in answer to this written motion... I don't see how she can possibly do so. hmmm.

The most fatal error in Leospanker's approach (Wake, Silver, 9th Dissent) is their presumption that negotiating a seniority solution other than the Nic might in itself inherently and factually be harmful, yet they all are forced to admit it isn't if negotiations are not complete. Ergo, what is or is not negotiated is not inherently harmful. The 9th got it correct and told you guys "wide range of reasonableness" is the SCOTUS standard for DFR but not ripe for adjudication until after all negotiations are complete and a final contract is in place (one which can be compared to the SCOTUS standard for compliance).

For a lot of money you can have them repeat that to you. And for automatic donations, you might be able to repeat their repetition. :lol:
