Looks like the EC, in their round-about way, is upholding the award.

You east guys can now remove the word "vacate" from your vocabulary.

There is a very simple way to validate your theory.

**Was the Nic. award passed down to the company?


The round-about is a good way to describe the circle that the award will travel forever.

ALPA National has released a resolution. They do not have jurisdiction over the merits of the award or the power to vacate it.

If the East has a problem they have to send it to the arbitration board.

Award stands.
 
I think USAPA's chances of taking over pilot representation just improved a great deal...
 
its another judge that will overturn the award not ALPA national, yeah yeah i know never gonna happen, have you looked at what rulings have occurred in the great legal system (with the exception of the 57 million dollar lawsuit for lost pants at a dry cleaner)(yeah thats a true story). I would suspect that should a suit occur and if it is a win or over turn then NEXT suit would be against ALPA national (yeah thats how Easties can get part of their pensions back)please see the MDA offer of 1.0 mill (already turned down). in the mean time NWA CAL DAL UAL and yes LCC again should be very worried about future consolidation. Throw in a few extenstions in the court system and this could easily drag on for 7 or more years which in and of itself would vacate the award since most of the Easties would retire in that time and be replaced by Easties (f/o's)


bringing it back into focus, flights are running at record loads, there should be record profits coming, ontime performance should be up, customer perception due to the low fares should be high. my guess is none of this will be reported, why? solve the problem, because if you do not you will end up with the award as it stands to a company that no longer will exisist in its present form.
 
Where are today's updates?

All over the west board. I can see the east is working damage control before releasing info. Typical!

It also has a pretty clear section that points to national taking over the East if they don't cooperate fully in obtaining a joint contract.

Receivership is coming. No votes for the East.
