You mean the arbitrated list that doesn't have to be used?
If the offer from the company does not match the monetary offer the American pilots got as far as signing bonus goes it is a NO vote from me. I could care less about any American merger. It won't be anything good. A lot of East guys feel the same way.

Actually it's the list that MUST be used unless there is a Legitimate Union Purpose not to. We all know you Idiots don't have one. Never did, never will. So Yes, the Nic is the only list.

Quite obvious you missed what MOU1 had.
 
Personally, I don't think that at all. I believe the best case, the most bulletproof case, the most durable case is a three way integration using the current paradigm all under the umbrella of M/B. Of course, you won't agree. More than that, you CAN'T agree because you have the NIC and you want it to the point of desperation. I for one do not feel any desperation for DOH. There are those that do and they are more financially driven than philosophically driven. What the company wants, what the APA wants and what USAPA needs is cover...a defensible position. I believe M/B gives them that and I would support whatever is awarded under that method. Then you can file your injunctions and your lawsuits and see how much traction you can get with them in federal court. Just my opinion, but I would guess, not much.

Here is what the 9th said Oscar. You say USAPA will lose. How does USAPA lose, when the 9th Court of Appeals said this. CITE YOUR case law, or shut up. It is easy to say what you do, but you are just an opinionated loud mouth with no legal standing. How is this for starters? Are we going to get that other idiot Jetzz running his mouth too?

Well, I won't type in 82 point font so guess that means I lose the argument. The primary court case is the Rakestraw case. It says that you can change a seniority list but you have to show a greater union purpose that will benefit the entire group, you can't simply trade off one angry group of employees for another angry group of employees. That is what USAPA's DOH list is attempting to do. There is no greater good for the entire group, it is simply the majority that is upset with the outcome of a fair and equitable process trying to extort by force what they couldn't win legitimately. That is how the outside world views it. All of the outside world.

What the Ninth was saying was that you can't sue over ongoing negotiations when you don't know the outcome. What if USAPA decided to put all the West pilots at the top of the list, would the AOL group still want to sue. There might be other lawsuits from other people but not from the West pilots. What if they simply exchanged numbers with 1000 and 1001 on the seniority list. What would the damages be? That is what the Ninth said. Negotiations are a fluid process and you can't sue based on an outcome that has not been determined yet. They also defer to the parties right to negotiate rather than legislate the outcome. I know you read into that statement carte blanche to do whatever you want but the rest of the world doesn't see it that way.

The best response is to read Judge Silver's ruling. She told USAPA in no uncertain terms that there is an axe poised over their neck. That axe is held up by a gossamer string. It will take very little to break that string and bring the axe down and chop off your head. That is how the entire world out of USAPAland reads that statement.

It is over for you. You can either realize that and get some money, or you can just continue on down your disastrous path and wait until that string breaks. I really don't care which way it goes for you, but there are lots of innocent pilots, held hostage by the crazies at USAPA that I care about. You will have your day of reckoning and it's getting close.

Oh, and just to rub salt in it, I am a fairly senior 757/767 Captain and I make more than your entire 757 crew does. That comes from accepting the world as it really is and not as it exists in some fantasy.

The rule of law and ethics will prevail, my faith is in our law. Everyone has rights and all men are equal, whether you like it or not. Reason trumps emotion in this great country. I believe the "tyranny of the majority" crowd is about to get their a$$ kicked...

You chicken-eating stupid ####. APA has already agreed to the Nic. If you'd pull your head out of that bucket every once in a while you'd see it coming.
Show us the proof. You guys are getting more desperate by the minute as the Nic slides away.
