It's been said here before, but it's worth repeating. You know the USAPA clowns are nervous of what's coming up their six when it gets quiet around here. Gone from 20 pages a day to 2. It's over!

That does not explain hoe you get to DOH.

There is no way the APA want DOH. DOH places 85% of the east pilots in the top 50% of the combined list.

DOH places 2500 east pilots (77.1%) with 2500 american pilots in the first 5000 (28.5%).
DOH places 5950 american pilots in the bottom 8600 (69%) and only 560 east pilots in the bottom 8600 (6.5%). Essentially stapling a majority of american pilots to the bottom half of the combined list.

In what universe do you think APA is going to allow that to happen?

LOS would not change those number much.

Not using the Nicolau sure trip to court.

Use the Nicolau no extra negotiations needed. The US Airways pilots are evenly distributed through the combined list.

Now again how does usapa avoid the Nicolau and get DOH?

I'm not saying they have a chance of DOH, but remember who will be representing us if it goes to arbitration. It won't be Leonidas etc., it will be USAPA. So in the arbitration it will be the arbiters, APA, and good ole' USAPA. Of course USAPA could try and make a deal with APA (outside arbitration) throwing the west under the bus. USAPA may enjoy liability and lawsuits, but I don't think the APA would go for it, nor the company.

The McCaskill-Bond statute was law during the Southwest, Air Tran seniority. How did things work out for Air Tran?

Bozo, that's apples and oranges. Southwest aquired Airtran, this will be a merger. Or are you thinking the east with it's wholly owned commuter (the west) is aquiring AMR? Claxon, how do you even function on a daily basis with your head so far up your ass?

The timeline has been determined by the term sheet.

If we merge, the APA will petition for single career status ASAP. May take a couple months for the NMB to declare the winner (without a vote). At that point usapa goes away, disappears like a bad nightmare.

So we will have a new union and a new joint contract BEFORE we get to seniority arbitration.

The union representing US Airways pilots will be APA. I seriously doubt they want DOH or a court battle by not using the Nicolau.

usapa is incapable of making a deal. They are constitutionally restricted to DOH. When the APA says no, negotiations are over. usapa does not have a plan B.

Straight to arbitration, handled by APA.

Airtran pilots agreed to it, they didn't go to arbitration.

Fences, fences. A five to seven year fence takes care of all their problems. The Nic is another problem for them. Not legally.Just in its use. They have NO obligation to your windfall. They know absolutely it was never implemented. Not even a factor other than an issue to avoid. They have no worries legally, only the damage it does to them. DOH with fences gets rid of the easterners, and then the no Nic goes into place and they go on top of you. It is that easy. Even a caveman would do it.
