COURT OVERTURNS SOTOMAYOR; SIDES WITH WHITE FIREFIGHTERS5-4 on ideological lines

WASHINGTON – The Supreme Court has ruled that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

Hopefully this will put the kabosh on her confirmation.

The origianl appeal was before a 3 judge panel. I cannot find a published vote but at least 1 other judge agreed with her. After that a 7-6 majority voted to deny rehearing the case. The COTUS vote was a 5-4 split. Hardly a resounding defeat.

From what I have heard I agree with the COTUS position on the case but that does not mean the decision was based on the USC.

I doubt this will affect her confirmation.

Judge Sotomayor worked for PRLDEF in various capacities from 1980 until she became a federal judge in 1992, spending most of her time as a board member.

The documents, which the group's lawyers have said include relevant information about Judge Sotomayor's time there, also show the fund did legal work for the Association of Community Organizations for Reform Now, known as ACORN. During the 2008 presidential election, ACORN came under fire after allegations of voter registration fraud.
