Where was the scrutiny when the big 6 that are now the big 3 were merging? Mobil/Texaco, Shell/Chevron, Union76/BP?
 
i think that may be a lot of slots at the hubs and a few at DCA and LGA will have to go too and other issues to get it thru
 
Its possible this might happen. But the post-merger airline will be very different than Parker intended. I think DOJ and others will demand more divestiture than Parker had planned on. What that might be is a guess, but is my hunch.
 
Delta will be rushing to come out of BK early if possible and time is against this deal.

PNH, actually that's not at all true. If the creditors and shareholders want this merger/hostile takeover to go through, that will hold great weight in the ruling of the BK judge. I'm sure the creditors committee has already teleconferenced on our proposal and I can't imagine that they aren't giving it serious consideration. The BK proceeding isn't about what's best for Delta, it's about what's best for the creditors, and that's how the judge must rule.

The bid was presented two months ago and was dicussed with the creditors. Gerry's response to dougie afterward was to pound salt.... two months ago.

They given it serious consideration and the answer was no, so dougie is either acting like a spoiled child or there is a plan B. Either way this merger will not happen.

I'm still hearing that one should be watching who is flying to Chicago.....

yes your right the bid was presented two months ago and was discussed with the creditors. the difference now is that there is 8 billion dollars involved. i don't think they discussed that 2 months ago. money talks my friend.
 
I for one would be shocked if this every happened. Delta is a proud and stubborn co - shareholders and employees. For a small little co like US to "take " them over would ruin their fragile ego. But then again, stranger things have happened. This should get VERY VERY interesting...

According to a personal friend and attorney, that is not true. The judge only has to find that DL did not entrench itself, ie poison pill, in regards to the merger. It is simply not a matter of who is the highest bidder.
The creditors committee does play a large role in deciding which rode will be taken, however, if DL can raise concerns over the viability of US's proposal and concurrently demonstrate that its plan is viable and equitable, it would be approved.
At the very least there are unanswered potential DOJ issues associated with this deal. In addition, it would almost certainly extend DL's BK timeline. Both are legitimate reasons for the judge to grant DL's proposal over US's speculative plan even if it promises a greater return for investors.
Some here have alluded to DL's creditors knowing the particulars of this deal before the announcement. If that were true, why has US requested a meeting with the BK creditors committee in order to present its deal? If the creditors had been tipped about specifics, it is highly unlikely those would not have been leaked to the CEO of DL. According to him, it was a complete suprise.
This merger is wishful thinking on the part of US. It hasn't even been able to sucessfully integrate the merger already on its plate.
US needs to get its own house in order before is starts begging for seconds.
 
It's all a smoke screen. Just like America West (US Airways) going after ATA......bad deal, no problem, gobble up US Airways. Same sort of thing...Doug will merge with some airline.

Offer was the same two months ago. dougie didn't get what he wanted so now he is trying to force the issue with a hostile takeover.
