I fail to see any question marks in there - was it supposed to be a question???? <- question marks in case you don't know what they look like.

Like Nosum and AWE, you love to ask questions and demand answers, but aren't forthcoming with answers. Too busy taking swipes at anyone who doesn't accept the all-knowing pronouncements of Pi the great. Since you provide no answers, why should I? Oh...that's right...because the all-knowing Pi says so... :lol:

The Nic was never on trial. Using a perceived sense of unfairness as a defense just doesn't cut it and, as a result, you lost on the merits of the case. Only ripeness saved the day. With DFR2, you won't have that.
The east had a legal out and opted to use it. Not unexpected by anyone. So what's for supper?

The Nic was on trial from day one. The merits were never an issue when we went to the 9th. You were devestated by the ripeness, which was the tactic.Merits were never an issue.



The judge ordered that USAPA must negotiate to implement the Nicolau Award unchanged into a combined collective bargaining agreement. It also ordered that USAPA could not negotiate separate agreements for the pilot groups. A later hearing on monetary damages, if any, will be held.







The court was also wrong about whether the case was ripe to be heard since the only action taken by USAPA was to make a proposal in bargaining. No actual agreement was reached with US Airways to change the Nicolau Award. In fact, the court admitted that US Airways has not responded to the USAPA proposal. So the proposal cannot have caused any injury to the plaintiffs.

You know Jim is just not used to being questioned. He was probably the only pilot over at FFocus and as such could pull off his B.S. without anyone calling him on it.

I think he is slipping. I flew F/E for him when he was about my age and he seemed Ok, if a little Columbo like..........

Save your cash then for the West pilots. You didn't listen to Baptiste and Wilder, you don't listen to what the 9th said obviously about the Nic, so it is always interesting to see how the West spend their cash...........Your lessons are quite costly.
