Apparently you never been to the bankruptcy court and attended any of Judge Mitchell's hearings.
The IAM and its lawyers were in court everyday fighting for the membership, I know I attended some hearings.
The company did not want to reach a T/A, the judge abrogated the contract, the company was free to impose anything they wanted at that time, they threw out a final offer to the membership and the membership ratified it.
You seem to fail to understand the bankruptcy laws are made to protect the creditors and the company and to hell with the employees.
Why after so much time and two bankruptcies do you posters still don't get it?
The TWU represented workers will remain under the CBA until a transition agreement is negotiated.
You can't force a union to hold a vote, they have the right to recind their petition.
I have just been notified that a possible suit in District Court agaisnt the NMB may happen to reorder the election, to protect the right to vote.
That's about all I know. It is being reviewed 'deeply' with certain 'contentions'.
Sometime in the next 48 hours we will find out for sure. A "Top firm" is looking into this and seems to think there may be a case.

Hey Brutallyhonest, Is there interest in a real UNION like the Teamsters? The AFL-CIO could care less about the members. So I feel it's time for change. Maybe if we had a UNION that cared about the vested and loyal EMPLOYEE's that this company still has you wouldn't have to test the water outside? Today we posted a 5 mil profet, so if this company cares and we can work together maybe we need a UNION that SPEAKS FOR US!
