Then why are both the APA and the Company in favor of it? You're in denial so take all the time you need but it's increasingly clear the West will have its own representation. You should be happy, for surely the arbitrators will recognize how that senile/crazy/bought-off Nicolau guy was so wrong and you'll be hansomely rewarded.
It's a win-win situation for the East!

When the lawsuits come, the company and APA will still be here and USAPA will be an excellent scapegoat, but only after APA and the company have demonstrated their best attempt to do everything they can to advantage the west.

Yeah no **** that is what they kept telling us.... we cant talk because we have no legal option for someone to represent us. Now they want someone to represent them...unbelievable

USAPA is your rep. You might not like it. Many east pilots would prefer ALPA, but they were voted off the prop. It was the west's choice not to offer a fence and in turn caused ALPA to be voted away. Their own doing. No sympathy here.

Where have you read the APA is in favor of it? Or even the company for that matter?
 
I think the company could really care less how this plays out. They need crews to fly the planes wherever they decide they should be flown. Their only concern may be to mitigate litigation, but I'm sure they realize that will most likely come regardless...
 
Any union is naturally opposed to the company in any negotiation. The APA will fight for it's members in the SLI against the US Airways pilots. That's the nature of the beast. Everyone knows and expects that. So the APA will be against USAPA in the SLI negotiations. That's one opponent. Why would they want to add yet another opponent (A West class) against them in a SLI? Do you think the APA will take the West pilots under their wing and try to acquire protections for them even though they are not the members the APA is charged with protecting? Any gains in protection fought for by the APA on behalf of the West pilots, would have to come in the form of reduced protections for it's own membership. I highly doubt that will happen. That's not how it works. I think it's foolish to think the APA will sacrifice gains for it's own members for someone else. Just look at their SLI history. They are not friendly when it comes to their seniority list. 
 
I think the protocol agreement will spell out how this will happen. Three lists all merged together on the methodology the merger committees come up with. This will probably be the best the US Airways pilots can hope for. And if the APA members and USAPA members (East and West) are all equally pissed off about the outcome, I would say it was a successful integration...

If you'd read the company's filings with the court you'd know exactly what the company wants.

Really? Then why did they file the declaratory judgement suit? Why did they have intervenor status in the Addington II suit? They care a great deal. For seven years USAPA saved them tens of millions of dollars but that has finally played out. Now they're following the course of least resistance. The West's DFR case is as clear as can be and the only way to prevent Addinton III is through the Nicolau list.

But wait, USAPA can use the leverage afforded by their 4500-strong pilot base. Ha ha!!
You divided the pilot group and ensured we'll have zero leverage. Well played.

Despite all of that, Judge Silver found that the west is NOT entitled to a seat at the table.  In the newest filing last week, the company didn't even argue that point.  They want the language clarified so that the lawsuits will finally end.
 
You guys are proud of working against your union, and call others "scabs".  Pretty funny, really.  Or, it would be if it weren't so sad.
 
You have a little less than 1 day to file your appeal.  Better get on it.

We've already heard one of you amazingly arrogant and infantile village idiots (nic4us) imply that ever even getting hit by the birds wouldn't have happened, were such as he at the helm, so go ahead and dazzle us all, step-by-step....? Tell us all exactly why and what "you'se" would've done, and what the unquestionably superior outcome would've been.  Hold nothing of your "professional" knowledge and proper use of presumed skills back. If you can't explain exactly what you would (or might at least imagine) have done, then just Grow Up!  Seriously; it's utterly disgusting to have even the most remote association with such brain-dead-but-arrogant-fools as "you'se".
 
Have some reference material for study: http://www.ntsb.gov/doclib/reports/2010/aar1003.pdf  Perhaps even the most unbelievably dense of all possible morons might notice a portion contained: "On January 15, 2009, about 1527 eastern standard time, US Airways flight 1549, an Airbus Industrie A320-214, N106US, experienced an almost complete loss of thrust in both engines after encountering a flock of birds....." versus "you'se" BS about "an operating engine".
 
You've the stand. Feel perfectly free to deeply impress us all, or otherwise risk just making an even larger and more incredible jackazz of yourself at "you'se" earliest convenience.

If you were at the trial you would see that Silver ruled the MB statute does not provide for what the company wants.

Not entitled, yes, prohibited, no. You're ignoring the part of Silver's ruling where she said we lost the case by the slimmest of margin. USAPA will be non-existant within a few months and after that the APA will have to do what USAPA is intrinsically incapable of: fairly representing the West pilots.

I'm shocked, SHOCKED your feces union didn't inform you that the company's Rule 60 motion extends the deadline for an appeal.

I am sure when the PROTOCOL AGREEMENT(CHIPS WEB SITE) is passed back, the rewrites will be very clear to all!
