Dear Mr. Rainey:
 
USAPA requests that the NMB issue a list of seven arbitrators pursuant to the McCaskill-Bond Amendment and Section 13(a) of the Allegheny-Mohawk LLPs which the Amendment incorporates. In relevant part, Section 13(a) provides that if the parties to a merger seniority dispute have not come to agreement on a method of integrating seniority within 20 days of the dispute, the dispute “may be referred by any party to an arbitrator selected from a panel of seven names furnished by the National Mediation Board for consideration and determination.”
 
We therefore request a list of seven arbitrators for the purpose of resolving the issue of seniority integration arising from the merger of American and US Airways. We recognize that it is the responsibility of the NMB to fashion the list. Nevertheless, given the nature of the dispute, we suggest that the arbitrators on the list be members of the National Academy of Arbitrators, have substantial airline industry experience and, in order to permit the most efficient and effective proceeding, have experience in airline seniority integration proceedings
 
The other parties to the dispute and their representatives are listed below and have been sent copies of this letter.

...and exactly where is its use prohibited? After all, a Federal Judge reiterated several times on record that the nic award was powerful evidence of a fair result...where's the powerful evidence that DOH is "fair"?

Nice try. Where is it written that the nic award is prohibited for any future use and where is the "powerful evidence" that DOH is as equally fair as the Nic.

Ok, I know I miss a lot when flying, but what the hell happened when I worked today?? dca319 has now tried to "coin a phrase" with his new found word "Persian"... I mean he has used it in almost EVERY post of his over the last 24 hours... Maybe he wants to claim credit for coming up with a common household phrase... I think it will fail miserably... I think even any real West posters on here look at his posts and cringe... Even they don't possibly believe he is an East pilot... Lol

 
Not exactly sure (because I skim through postings made while I am flying,) but I think the Persian reference has to do with the fact in history that the Persians destroyed the Army of Leonidas.  I don't know who applied the "Persian" term to the east, but it simply reinforces the fact that AOL has "again" been destroyed.

So you finally understand that the Nic is prohibited but that there is noting prohibiting a negotiation to change the current prohibition, in order to implement the Nic in the future?  
 
How many donations did you have to make to Marty for him to let you in on that secret?  Is that why he tried to get you a seat at the negotiating table?  The only road to the Nic begins with negotiations?
