You don't understand "implicit assumption" yet.  But you appear to be guilty of it none the less.  Answer your own question... "Who has to affirm the Nic?... and How would it be affirmed?

........FOR AA DO YOU AGREE WITH THIS....I think you are missing the boat, I say this being our sixth merge 99% of the east pilots respect DOH we do not want your jobs or big airplanes, hard to believe but true we should not bump any of you and your big planes should be for you guys, it's what you brought to this merge. That is what the east thinks the west on the other hand think they should get all your premium flying and go right to the top.

Ok,
No one has to affirm the NIC.  You agree'd to binding arbitration and the arbitrator ruled.
 
Unless USAPA manufactured a bill of good they're trying to sell.

I agree.  If his/her DOH would allow WB captain, then that is where he/she should be after the SLI.
 
I can't see any possibility of fences between east and west once the SLI is in place.  That would make no sense because, as you say, AAL is merging with LCC, not US and AW.

I had to re-read that three times..
 
We'll deal with the NIC list, or the Arbitrator will.  A pre-merger (AWA-USAIR) DOH is a part of ancient history.  Look back and see what that firm belief cost you economically.

Again your confused, it has cost the west way more than us in legal fees and not participating in DOH, hundreds of westies could be on a big plane plus the upgrades and growth is east.
