Trader the only way to minimize the APA DFR liability is a M/B SLI with USAPA,  the DFR knife for the APA cuts both ways. It will be arbitrated I agree but a group without class certification will not be present, The West has representation, just like empire. shuttle, etc!
like Obama is snap's president, USAPA is the west's rep, legally elected.

Call it my Kasher prediction.

APA and USAPA will never reach a negotiated list because anything acceptable to USAPA exposes APA to West DFR liability.
Anything acceptable to the West exposes APA to USAPA DFR liability. It won't look like the NIC...it can't. The current paradigm that will form the basis for the economics that will drive the merging of the lists is so far removed from what it looked like in 2005. Only in the time warp you seem to live in can you plug in a list that the judge said TWICE had no standing.

I "expect" that you are wrong and that the LISTS acknowledged in the MOU (note the use of the plural form) currently in effect, will be combined with the APA list, in a three way, using a snapshot taken at the POR, taking into account category and status with a LOS and an attrition factor applied to all three LISTS, see United/Continental SLI.  There will be no accommodation for OBE "ancient history".  Will they give the West credit for the East flying they are doing today? That's the real "question" at this point.

Get back to me in a few years after all is said and done and we can compare the accuracy of our differing "expectations".  We shall see.

I agree with most of your post. I'm just not sure the East flying that has kept the West min fleet count alive will be a player. Good post though...

I don't think the arbitrators will entertain a list that cannot be used legally.(Such as the NIC)
Three lists, two unions, one arbitration.

I expect the MB arbitration panel will combine the East and West list to reflect the Nicolau Award and then combine that list with APA.

It won't be called the Nicolau Award so USAPA will claim victory.
Traitor is the lap dog of Leonidas. The spin is always Nicolau. Damn the facts of law.

"You'se" kids just really and plainly need to grow up...or at least make the, if even futile, slightest attempt. "Born on December 18, 1879, in Gori, Georgia, Joseph Stalin rose to power as General Secretary of the Communist Party,.." "Joseph Stalin dies March 5, 1953...He is remembered to this day as the man who helped save his nation from Nazi domination—and as the mass murderer of the century, having overseen the deaths of between 8 million and 10 million of his own people." Are, even CAN any of you almost unimaginably infantile fools fantasize that anyone living to the age of nearly 74, and after literally ordering the murder of millions of people and dies yet wielding absolute power, and without severe suffering from any hideous and lengthy demise, serves as proof of supposed "karma", in any way, shape, form or fashion? Must we just assume that he had helped a whole lot of old ladies across streets in previous lives? 🙂 How about this other example of supposed "karma": Poor nutrition causes nearly half (45%) of deaths in children under five - 3.1 million children each year. Should we all now assume that 3.1 MILLION children under five years old "deserve" such an agonizing fate each year? Still want to ramble on about "karma"? Sigh! I sometimes must honestly wonder; is it even possible for people to be at all, or even halfway as stupid as you would present "you'se" selves to be, and have us believe? 😉 Seriously; just grow up!

Mr. Gary Hummel,
Without due respect - each and every action that this so called union has taken since its inception has been done with the sole purpose of alienating and inflicting harm to the West pilot group. The latest in a continuing series of blatant misrepresentation is the forwarding of a letter sent to the BPR from one of our West Captains to management.
Was the hope to have management discipline this pilot? The hypocrisy! Your shameless BPR chose not to engage with the same disdain and measures regarding a letter sent to a Federal Judge.
Are we not entitled to free speech? Are we not allowed to question or criticize this so called union that we are enforced to pay dues to? Where in the Constitution and By-laws of USAPA does it say that members cannot and will not write unpleasant letters to the BPR? It is our DUTY to voice our own opinion with regards to the representation that each of feel we are receiving from this so called union. That is how a union works democratically.
The BPRs decision to send the West Captains letter to management speaks volumes as to where your collective minds are. Your backs are against the wall and you are running out of options the day that USAPA will cease to exist will soon be upon your East pilot group. At that point your petulant band will the minority and karma will rule the day. You may find comfort in a small minority of pilots in this industry that may believe in the Easts plight, but it is a small group. The vast majority of industry pilots finds your group abhorrent and in contempt.
My only comfort is in knowing that a majority of your brethren - due to retirement - will be off property by the end of the decade. At that point each of you can reminisce and reflect on a job well done.

Here's a clue,,,,CA PHX A320
Under the leadership of new hire Eric a Ferguson, the rest of the new age Spartan first officers rolled the dice. Just think, had they compromised just a bit they would have the benefits of their windfall in a few months. 330 seats, multitudes of upgrades.
Karma bit them in the keister.
Karma.
Greed killed good karma.
When you see Eric, give him a hearty thank you from the east pilots.

All very wrong. You will get a lucky break if the APA pilots are foolish enough to risk their high paying jobs. An arbitrator looking at east growth may open the door to them.
The west will not get a seat. They are represented by USAPA.

The West has a lot of enthusiasm and camaraderie but they no longer great each other with a "fist bump" or "high five"....  They now do a "Liberty Necktie Smash" and "Belly Rub".  DO NOT try to picture that in your mind!

Just a loud mouth for Munn, you can quit "begging" USAPA to give them a seat.
