USTUPIDS attempted stunt in Lanes' courtroom, as per normal, blew up in their faces. Withdrawing the suit now isn't going to stop Lane, the UCC or AMR from getting their ripeness arguments in front of Silver. There's only one party to this massive bowl of Alphabet soup that doesn't want this issue resolved before the POR. That party is having its ass kicked back into Fed. Court.

Reading the USAPA updates, I can't fault any Eastie who really isn't paying much attention to this for being absolutely stunned and in disbelief when the Nic. Is placed via Injunction. USAPA is criminally deceitful and will only tell1/8th of the story to "keep hope alive"

Let's hope the Silver Court imposes the Nic. Always wanted to see NMB lawyers parachute into a courtroom. Remember Wake and his sleeplessness about it? Even the judge who got spanked by the 9 th wouldn't go there.

I'm just curious. If this situation is ripe, and If somehow you do manage to get a temporary injunction on May 14th and then at some point in the future If you're able to get a permanent injunction for USAPA to use the Nicolau award, and then If you somehow win on appeal to the 9th circuit and then you finally get APA to negotiate a combined list using the Nicolau award, what changes? When will you be able to bid CLT? The company has no plans to combine East and West....none. They will combine all of us (AA and US) at the same time. Maybe 4th quarter of 2015 if we are lucky? The East has 500+ mandatory retirements between now and then with 99% of them being Captains or Widebody F/O's. No bump, no flush...remember? And being melded into AA, the pool will get even deeper. I don't think any East pilot is afraid of the threat of Nicolau anymore....even If you win.

Were the f/as under our T/A? Remember that clause in the TA that said it could be amended at anytime with the agreement of the parties? We did just that on Feb. 8th. As Gunter said, even if you win on the Nic, good luck cashing in for several more years
