And though USAPA filed a motion to change the venue of the underlying action from Arizona to New York, Judge Lane noted that because the dispute in New York does not directly involve AMR or a creditor, he is uncertain that he has jurisdiction over the matter right now.
He did say that if the Arizona litigation either does not resolve itself or results in an outcome that affects the merger, he would be willing to address the case at that time.
An AMR attorney agreed, telling the judge that there is “absolutely no reason why this case should be on your docket.”
