April/May 2013 Pilot Discussion

Leave it to a US pilot to get it wrong.

He is not an arbitrator, he is a mediator who is the head of the Federal Mediation and Conciliation Service.

And before that he was a lawyer and negotiator.
And also a member of the National Academy of Arbitrators. That would also make him a qualified arbitrator. Leave it to a former cleaner to get it wrong. Again. By the way, the new cleaners put your group to shame in half the time..

west, bad idea to accuse the company in your filings. Marty and Andy want their money, this is their last gasp.

"III. Claim Three: Attorneys’ Fees

113. Plaintiffs re-allege each and every allegation set forth above as
if fully set forth herein.
114. USAPA has several million dollars in reserve collected as dues
and agency fees from all US Airways Pilots.
115. Plaintiffs brought this action and the 2008 action and appeared
as defendants in the 2010 action to vindicate the right of all US Airways
pilots to fair representation by USAPA.
116. By obtaining the rulings in the 2008 and 2010 actions and by
prevailing in this action, Plaintiffs conferred a substantial benefit on all
US Airways Pilots.
117. Under common benefit doctrine, the expenses of achieving
those benefits should, in all fairness, be spread among all those who so
benefitted.
118. The expenses of achieving those benefits would be fairly spread
among all US Airways Pilots if paid by USAPA.

119. The Court should, therefore, make an award in favor of
Plaintiffs and against USAPA for all reasonable litigation expenses,
including attorneys’ fees incurred bringing this action, incurred by
Plaintiffs in the actions noted above.
IV. Prayer for Relief
Plaintiffs respectfully ask the Court for the following relief:
120. Judgment that USAPA violated the duty of fair representation
by, among other things, entering into a contract, the MOU, that provided
substantially better wages for East Pilots without requiring their
agreement to implement the Nicolau Award list;
121. Judgment that USAPA is continuing to violate the duty of fair
representation by insisting that it will use a date-of–hire seniority list
rather than the Nicolau Award list;
122. Judgment that US Airways, with the consent of USAPA, is in breach of the implied covenant of the Transition Agreement;
123. An injunction requiring Defendants to conduct seniority
integration according to the MOU procedures but using the seniority
order in the Nicolau Award list to order the US Airways pilots; and
124. Judgment awarding Plaintiffs the reasonable litigation
expenses, including attorneys fees, incurred since 2008 protecting the
fair representation rights of the US Airways Pilots.

Dated this 6th day of March, 2013.

You might want to check your facts. Nicolau is associated with most major sports leagues and is still viewed as one of the premiere arbitrators in the country. I think he was the head mediator for the recent NBA contract. But I know that facts mean very little on this forum so proceed.
Why didn't you guys choose him for your SLI then???????? And why didn't United/Continental choose him either if he is such a premiere arbitrator?

Did you not notice Oscar referring to Nicolau as both an arbitrator and a mediator? And how is it that you know the difference between an arbitrator and a mediator but you cannot tell the difference between a pilot going back in the cabin for a newspaper to read and a pilot cleaning a plane? And aren't you the same guy that negotiated away his own job?

Nicolau was fired a long time ago by most sports venues. Google MLB fires Nicolau.

I believe George Nicolau got a little lazy working for alpa. He sat home and let alpa do the writing and the decision making. Tsk, tsk.

As far as Oscarjazz goes, he is an alpa shill working for Delta airlines, Google Delta lands on taxiway. oscar should spend more time voiding and cleaning up, in his own back yard.

EastUS1, on 23 April 2013 - 01:21 PM, said: I take it you must mean some/all of your noble, self-styled "Knights", who've "fought with valor in many battles" in supposed "war"? Who would ever dare offer insult to such heros as you have in abundance? 🙂 The terms westie and "war vets" have precious little overlap. Run along now, mighty little "spartan". 😉

PS: Any needing to bask in the presence of a true AWA "hero" need only view this inspirational video...produced while American soldiers were/are suffering continuing casualites in the harsh, real world...while pathetic and incurably infantile little punks like this puff up their tiny, T-shirted chests in the comfort of home. Go "spartans"!!! https://www.youtube....feecbzFQfxT_9pQ

As opposed to you, playing drunken late night internet tough guy...

Hypocrite

I was just told of this charming post of yours, appropriately self-styled, little Monkee. While many of us out east gave at the office long years ago now, as in; likely well before your "senior" prom; it's amusing to observe that your/cleardirect/et al's fervent respect for "war vets" apparently concerns only Mr. Nic, who's service and personal sacrifice I also fully respect. No matter. It comes as no surprise that you've the same "respect" for other's experiences as you do their years worked, and, well... all of us have/had an age-limited-shelf-life in that particular business. I suffer no burden of hypocrisy for no longer being directly involved. On the other hand: If you've sufficiently tender years yet...my only suggestion would be that you now go show us all how it should be done...outside of being "knights who've fought with valor in may battles", in "war" entirely inside Fantasyland, of course. 🙂 My suggestion, for your personal safety, would be to stick to hawking T-shirts, videos and typically AOL-internet-tough-guy-BS. The world outside Fantasyland's not as you "spartan heros" might imagine....just sayin'.

PS: Whenever you reference Mr. Nic/"war vet"/etc ...well...it's my best guess that whatever else is true of a man who flew in battle with the Mighty 8th and sacrificed a leg in the process....I'll go with the idea that he'd not be much impressed by your "spartan" sorts...not even your "knights" and "dire wolves". With far less street-cred than the 8th and a crippling wound; I'm sure not overwhelmed with your infantile BS. 😉
