Create a Leonidas style organization? Who couldn't? All you do is get a couple of pilot lawyers who funnel the cash to a half a$$ed lawyer

Really! You think that is all it takes. Just funnel money. Without the threat of termination where does that money come from?

You east guys have been fighting each other for years over every conceivable issue. The only reason you have any money is because of the extortion of section 29. Without the threat of termination you don't have the leadership or unity to pull off a Leonidas organization.

Least you forget you would have to run your organization on donations. With you easties losing record in the legal area sending you guys a penny would be a poor investment. After all you could not even get your own pilots for vote for another assessment for the PGBC. You had to steal it from general funds.

But like I said you would not even have standing to continue an appeal. That belongs to the union, APA eventually. In the interest of unity and moving on and the majority APA will simply withdraw the appeal, pat you on your head and tell you take a seat.

You assume an awful lot about the APA being on your side.

I'm no Lawyer but it seems to me you'll have a tough time at trial convincing getting past the fact 98% of you voted to amend the TA to a seniority neutral MOU that does not contain the Nic award.

That and the vastly superior pay rates to the Kirby.

Yes, though strictly speaking they didn't really vote to amend the TA. The MOU makes all previous agreements and status quo a nullity.

But who knows what Silver will say this time around. If she stays true to her new interpolation of the "actual claim" then she must find that 1) USAPA had a duty to negotiate to use the Nic, only the Nic, and nothing but the Nic.. or 2) their duty to fairly represent all pilots allowed them some discretion during their negotiations, and they did or did not remain within that dutiful range of discretion. Can't wait to see what exciting things she has in store for everyone!

You guys have been claiming all along that the east had no integrity because it used unfair methods to get out of a previously agreed upon deal. Now, you guys have one of your own craft the MOU, vote for it 97%, then turn around and claim that a provision of it is illegal. What's the difference? If you thought it was illegal, you should have voted against it.

If it wasn't for Judge Silver I'd say the standard of LUP is easier now that it was before the MOU. Before the MOU USAPA only had the theory that the east pilots wouldn't accept a contract with the Nic in it, but no proof. Now they can claim that we were in a quagmire and used the MOU as a way out, and that all pilots accepted it. With Judge Silver, who knows?
