Pi, have you even read the filing?

Yes, and please cut the WE crap. You are a westie. A west friend of mine told me that you confessed to stirring the pot as an eastie on here in a post on the AWAPPA board.

Why would you ask me if I've read the filing?
 
You guys have been claiming all along that the east had no integrity because it used unfair methods to get out of a previously agreed upon deal. Now, you guys have one of your own craft the MOU, vote for it 97%, then turn around and claim that a provision of it is illegal. What's the difference? If you thought it was illegal, you should have voted against it.

Actually, it doesn't. A union has a duty to fairly represent its members. Failing that, said union can be sued.

I'm not suprised you would think it OK to staple females. Most of our east pilots are ignorant to integrity.

And sorry, I'm afraid you'll be disappointed come 9/24. The west now has their ripeness and we have no LUP.
When the "constitution" of the union say their IGS members shall vote to approve or disapprove whatever is being "proposed"... it is the members who speak... not the union itself. That is why we ended up with LOA 93 DA! I didn't vote for it... but the "majority spoke" and I and others got ramrodded with it!
 
I was shocked that any of the west voted for the MOU in the first place, but they wanted it more than the east pilots!

The damages argument is now a far reach. 98% approval means they are quite happy with their situation. They got a raise and separate ops for 4-5 years. Their base is safe. Why the unhappiness?

There's nothing wrong with the MOU. If USAPA presents the NIC as the integrated seniority then the MOU serves the purpose for which it was drafted. The fact that the Company and the APA got dismissed from the matter indictes that Silver identifies USAPA's failure to acknowledge their responsibility as the sole issue to be decided. The votes on the west were not done in spite of an illegal provision, it just ensures that USAPA's delay tactics will not continue.

A union constitution doesn't trump federal law. Federal law states that you have a duty to fairly represent your members. Failing that, the members that have been unfairly represented can sue which is what the west has been trying to do. Now that they have their ripeness, come 9/24, USAPA and their lack of a LUP, will be taken to the shed.

We were all told the vote had nothing to do with integration. Care to see that USAPA message?

So if usapa had sent out an e mail stating that PHX based pilots would take a pay cut and CLT, PHL and DCA based pilots would get that additional money. The majority voted for it there would be no DFR is that what you are saying?

That's not what happened. The MOU renegotiated the TA and previous contracts because the union knew that we were being left behind. It negotiated better pay for ALL US pilots and it was up to the pilots to look at the changes and cast a vote as to whether it was better to stay in our quagmire and let our merger partner that was in Chp 11 reap the benefits while we continued to fight it out, or accept the changes and get the money. It was laid out, and we voted on it, with the west pilots voting for it 97%.

I feel confident that is what the union will say, because what else is there/

But, show your integrity. Wasn't it your plan all along to vote for the MOU knowing it didn't include the Nic, and then file suit claiming it was illegal? So you turned your back on an agreed upon contract. Sound familiar?
