I guess its just an oversight on USAPA's part. Since everyone is assuming the West Class will soon be "appointed" as a new bargaining agent on the property, we thought you could take care of yourself. Knock yourself out, send a LEO letter to the AZ Attorney General. Let him know how much "ripeness" is at stake in our appeal of your lawsuit. Have Marty threaten him. You NEED this merger. That will get him going! RR

We have a dues collector and West representation in the form of the Polsinelli Law Firm. The dues collector does nothing but collect dues and spends those dues. Then it decides it does not have enough dues, it raises those dues to the highest in the industry.

It can't help itself, it wants the dues that will be going to the APA so it doesn't want the merger to go through.

It feeds on it's own greed.

The dues are high because you keep suing you own union, despite the fact you keep being told the results you want will not happen. Good thing is, I have not made a single personal donation to Pat S. OR Lee Seham (oops, maybe the first $200 6 years ago.) Thankfully, you are making up the difference for me. As to USAPA not wanting the merger to go through, that is silly. They negotiated an MOU to do just that. You even found said MOU to be to your liking, and ratified it (with your 1100 votes, you could have shot it down.) What do we have to look forward to later Snap, more of your condescending and offensive accident porn, or just some more reminiscing on early USAPA?Also, a close friend of mine recently (yesterday) quoted Napoleon to me, saying "never interrupt your enemy when he is making a mistake." Film at eleven, you just cannot make this stuff up. RR

Marty is F-ing it up... His closing argument to Judge Silver on 15 Aug was that the Defendant must prove their innocence rather than that the Plaintiff must prove their claim...

MR. HARPER: Very, very brief. He's having difficulty preparing his defense. Judge, the issue is: What was the legitimate union purpose for doing what they did? They know it, they have to articulate it, and I have to beat it back. He has no defense. He should be up there first explaining to you what the legitimate union purpose was as a plaintiff, and I should be trying to beat it back. He's not preparing a defense. He has to prepare his story.

Marty wants to switch responsibilities with Pat. Marty is demanding that Pat have the burden of the Plaintiff. Really? I think Marty is worth every penny. Can someone please provide a link for me to donate? 🙂

We shall see if Judge Silver is much, much smarter than Wake. :lol:

Phoenix: You continue to shine on your legal review of current events. Coming soon is a reveal of West actions NOT related to Marty and Silver's courtroom antics. Remember when we were young and some "low donation to the gene pool" kid would hold the roman candle right in front of his body, and it would backfire. Yeah, something like that. (I WAS that kid, but luckily my dad corrected my error at the last moment!) Now, I just teed up enough images for you all to bounce off the walls for the rest of the night! RR

I'm glad to hear that, but some communication and clarity from the union would be nice. Due to some of USAPA's past actions, I think it is understandable that some of us worry about what they're up to.

If your union fairly represented West pilots, your union would not find itself in court.

If they were guilty of something you would think a decent lawyer could get some money from them after all these years. :lol:

HINT: A decent lawyer would accept his responsibility as a plaintiff to prove your accusation and wouldn't be begging the latest Judge to assume the defendant is guilty, forcing the defendant to bare the burden of a plaintiff.

The West reps should come out with an update in support of the merger and against the DOJ's action.

Hint: At some time in the past you folks seemed to be consumed with the notion of integrity. Why do you look forward to a Judge presiding over a trial that by her own words proves she failed to establish it is ripe, being represented by a lawyer that begs the judge to assume the defendant is guilty? Where is your moral outrage? :lol: Integrity indeed. 🙂

April 2012 comes to mind for some reason.

So, lets say the Judge finds USAPA failed their DFR, but the merger doesn't go through. Is she going to make it apply anyway. And if so, and you freeze USAPA's money so they can't appeal, what then? Still under the TA and can't use the Nic until a JCBA. What's next?

Serious, not a jab, what's next if there is no merger? Just want a failure of DFR ruling? You think it will apply when the case was about the MOU that doesn't exist absent a merger?
