The scab unions action are wholly irrational and arbitrary.
So, only if....does apply, and the scab unions actions do fall outside a wide range of reasonableness.

That's not at all universally true. Just a few excerpts from generally accepted Rules of Poker:
"The following situations render a hand invalid:" "Should two or more cards of the same suit and rank be found during a hand, the hand is made void and all chips in the pot will be returned to the players accordingly."
Perhaps most applicable to the present situation = "Other deviation rules are as follows:"... "Any player who notices a defect in the cards that they or other players are dealt is required to report this immediately." 😉

For Blackjack: "If during a round of play the continuous shuffling machine malfunctions, or two or more cards are dealt and the order of the cards cannot be determined and that round cannot be completed, that round of play will be void." Insert "Arbitrator" for "continuous shuffling machine" here, and ponder a moment on "that round can't be completed", just for fun. 🙂
