I must be out of touch. The company was dismissed and they want back in. Something smells fishy! The depo's are on the 17th and Siegle wants in. Do you think Silver grants him access?

It is okay, DFRII is on the way, not a declaratory judgement, but full on trial on the merits of why the scabs have dropped West grievances, made false billings on West members, intentionally put West MIGs in bad standing for no reason other than uscaba's own accounting mistakes, failed many other representational mandates including intentionally forcing separate ops, not negotiating with the company in good faith, and just generally being SCABS.

Nic, I don’t know if it was the same for you in juvie, but at my house, about this time every year, the Sears Catalog would show up with the big toy section. My parents would say we had better pick one thing we really wanted, and that they would work a deal with Santa. Not a laundry list, but one really desired toy. Apparently Silver is a harsh mistress, as she not only told you could only try your DFR on ONE issue, but she picked it FOR you (whether the NIC not being in the MOU is a DFR.) If Marty thinks the trial he is preparing for is about your list above, he is going to be showing up in a Halloween costume to a Christmas party. Somebody better wake (no pun intended) him up and get him on the right track. And while you are at it, BEFORE the trial, make sure he knows who the current elected president is at USAPA. He had a problem with that in DFRI. RR

The oh so fickle Company has taken a recent pro USAPA slant in regards to seniority proceedings. I don't know why, but assuredly it must somehow serve their own purpose and needs. There will be a very unnecessary game of Clue played out between now and throughout the trial, as to who wrote the seniority language in the MOU and what its intent was. The West contingent was THERE at the table. Everyone involved ( I think) needs to take credit for its creation. It is obvious from just reading this forum over the last 7 months that the goal of the West Class is to now somehow distance themselves from any intent or purpose in the MOU; you all know, the “we were tricked!” defense. That is going to be fun to watch. Unlike Cleary, the current group of Officers with the BPR has made darn sure the West has a seat on both the Merger Committee and the NAC. Maybe Bob just is curious about what devious tack USAPA will now take. Or maybe he just wants to make sure the language in the MOU survives the finger pointing. Maybe he wants to eat wings at McCoys. We can all guess all night as to his reasons for wanting to be there. Silver is enamored with Siegel. I bet he is making his hotel reservation for Charlotte as we speak. RR
