You don't have to buy it; the lawyers know. The TWA pilots' DFR suit against the APA, TWA, and AA was dismissed due to expiration of statutory time limit (which happens to be six months). At issue was when the statutory time began: we argued it was when the APA-conceived list was implemented. The judge and appelate court ruled it was when the list was announced. Crazy, but that's how it went down and why Leonidas had to file even at rist of dismissal without prejudice.

Feel free to count yourself among those with no knowledge of integrity, Poser. 90% are denied but that is many of them are merely billing schemes. Regardless, SCOTUS is the keeper of "Wide Range of Reasonableness" and all roads lead there. Enjoy the scenery. We have many moons yet to travel. 😀

I am sure that is what you were told. But San Francisco told you there was no knife thrust until a RATIFED CBA. So you listened to your lawyers (as we all seem to do) and they told you to go for it. Great payday for Marty. Both he and Wake knew darn well Addingtion 1 was toast after the Breeger decision in Charlotte. And I am asking this, I don't know. How did TWA get ALPA into court and not the others? I was under the (mistaken?) impression it was because the others were simply given a pass. What were the different circumstances with ALPA? And one more thing. A ripe DFR based on a ratified MOU in a merger that is not happening? Not seeing a knife thrust there either. RR

We ratified a CONTINGENT MOU, which CONTINGENTLY makes null and void the TA (but for which the Nic is void). Either of which is yet a contingent path to a JCBA. 🙂

As I have said, about two more years status quo with no new contract, and Zero chance of getting the NMB involved. Maybe longer. My family quickly adjusted to the new reality about 48 hours after the DOJ filing. We are not hanging on every news story, nor believe ANYTHING coming from the Wall Street press. RR
