We RATIFIED a contract. 9th satisfied. Well done. Nothing gets by the USCABA legal team does it?!


Ok, what merger is the supposed "ratified" contract for? AMR and US Airways? Not happening. And I suggest your PHX USAPA committee members at least consult your legal team on pending personal grievances. You never know what could happen when you ask a question you don't want the answer to. Or so I hear. RR

Regardless, SCOTUS is the keeper of "Wide Range of Reasonableness" and all roads lead there. Enjoy the scenery. We have many moons yet to travel. 😀

So is Silver going to reverse herself and now impose the NIC? Might as well, this entire mess will spend 2 more years in the courts anyway. Kind of a "slow motion" fall off the cliff. Plenty of time for review and reflection for us all. We are truly locked into status quo for years; other than your slight pay advantage in a single base, and my upcoming attrition to the 330. RR

No argument there, little "spartan"....of course, "integrity" would first have to find where, or if said targets even existed prior to any kicking. 😉

I am truly in despair at the number of illiterate (or quibling) graduates the public schools churn out. Communication is impossible if one must teach grammar before they make every point.

"Wide range of reasonableness." If Silver ignores what the 9th quoted from the SCOTUS, even after Wake got spanked,....

USAPA never made such a claim, but alleging so gives Silver something to work with, a new point of departure if you will.

It is becoming apparent that Judge Silver has no qualms about inventing a false, irrelevant premise in order to launch her departure from the bounds of the applicable law....

For example, "In the airline industry delay is never a good thing" ergo, we will hold trial without preserving the courts Article III jurisdiction authority... After all what is more important here? A judge's oath to uphold the constitution or an on time departure at the airport?

And now we have Judge Silver claiming USAPA says the West no longer wants to pursue the Nicolau. USAPA made no such claim or speculation, but Silver needs it to be so in order for her to ignore what the MOU vote in fact secured for those who ratified it. The case law is clear. You get what you agreed to, but Judge Silver need not concern herself with the case law because she can accuse USAPA of not giving everyone an MOU that they really wanted to have. They wished they could have voted on a different MOU, and by Silver's presumption, they actually did cast their ballots in favor of something they pictured in their minds eye. When i bought my Toyota I had a Jag pictured, so the Jag dealer owes me, dammit! :lol:

Its a real comedy of justice when a judge begins every order with a false premise and then nails it home with a non sequitur. :lol:

Bill Baer, the assistant AG is another Democratic appointee I believe. Is it within the realm of possibility that someone on her staff contacted someone on Baer's staff and asked, 'Hey, we have this case here in AZ and need to know if you're going to let this merger go forward or not ....it is?....okay, thanks, let's do lunch......btw, we never had this conversation.'

Warp speed? None of the rulings yesterday moved anything along any faster. In fact we have almost a 5 week delay in place...so far. But someone did see Silver at the Pacific Miniatures store yesterday, buying a 777 model in the new AMR colors. RR

She has been on an expeditious timeline from the beginning. Moving the trial date to October was a self imposed delay on her part, maybe the result of an earlier phone call, staff member to staff member. Anyway, no more conspiracy theories from me today.
