This is an endless circle. I have an idea Res. If we indeed ratified a JCBA, then the Nic should be published by the Company as "the list." Is that not what LOA 96 says? Before the trial with Judge Silver, why not have some of your guys file grievances to that effect. That way USAPA, the West Class, and Judge Silver will know exactly what the Company believes. At least it would get all of us, including the scab union, on the same page. I know, out to lunch. And probably not worth the risk of getting an answer one of us does not want to hear. As far as a recall of the President (and that is actually their only option on the wish list) the PHX reps can make that happen. Since there is now no merger, I cannot see why anyone would want to deal with this pilot group, especially the 62% of CLT pilots who cannot be bothered to vote. But I only speak for myself. RR

Any JCBA that I've ever seen has a section devoted to seniority, in our case it's S22 - and it's called 'Seniority'. You don't get to sneak in seniority like a Trojan Horse. If we want to settle the issue amongst ourselves, (either before we enter M/B or absent a merger) old rules apply. You must conduct a ratification vote on a JCBA with something in S22 which is in plain sight, or wait for harm and prevail in a unquestionably ripe DFR.

The MOU was a simple bridging agreement. There were entire sections found in a bona fide JCBA that were missing in the MOU, while other provisions were TBD. The Green Book does not reference our seniority.
