This afternoon US Airways filed a Notice of Appeal with the 9th Circuit. This means that US Airways will appeal Judge Silver's Dec 4th order dismissing the Company's Declaratory Action for ripeness. Your Leonidas team is satisfied with this action and we are prepared to advocate for the West Class during the course of this appeal. We will update you in greater detail later about how long the appeal will take and what we can expect, but for now we encourage all West pilots to sit back, relax, and ring in the New Year.
So it would appear that the company disagrees with usapa's assessment that they are free to negotiate seniority.

Appealing the decision. Either delays a stand alone contract like the hard line Cleary clowns want and gives evidence to the NMB not to negotiate until usapa accepts Nicolau or when we go into seniority integration with APA the company says to the arbitrator they have litigation pending and will not use anything that would get them sued.

DOH is dead. C&R are to costly and time consuming. The Nicolau is the only path to a contract stand alone or merged.

BTW, the Companies appeal will die with USAPA. If no merger, LOA93 was just extended at least another two years easily. Jetz will be closing his 2nd contract by the time USTUPID gets anywhere near a new (Nic inclusive) contract.

The economic fratricide continues unabated. Bradford will FOREVER be on Doug Parker's Christmas card list.

Pilots are incapable of working with anyone. All unions for pilots should be outlawed.

I don't care who is CEO. I'm coming to work and doing my job the best I can for the company starting in 2013, no matter who runs it.

APA, ALPA, USAPA, AFL-CIO, whatever, unionism is a failure and we're better off without it.

Parker doesn't know when to wear a coat and tie. Horton is never seen without both. So what does that mean? Nothing accept that Horton looks like a CEO and DUI looks like a frat pledge. 🙂

Seriously, Horton wants nothing more than to be the one in charge as AA exits bankruptcy and the longer he is able to delay a merger the more likely he is able to stay on top. The APA is desperate to oust Horton and in my opinion is a bit too in love with that outcome to be able to see the forest for the trees (they are starry-eyed over DUI, and that can never end well).

APA and the entire UCC have all benefitted from DUI's desperate attempt to beat Horton, but really, would you trust the world's largest airline to DUI? Or would you believe the most repugnant and foul mouthed poster for reliable analysis?

I still think my initial take on this proposed "merger" will turn out to be correct........Three pilot groups, Three contracts and Three rates of pay, with One new paint job, which will last for as long as management can possibly make it so.

Sure, that is going to happen. After all, Dougie already merged with UAL, DAL, and he has integrated LCC East and West pilots successfully. Wait, he did none of that. There is no way Parker can pull off AA. It will be AA in the drivers seat. As they should be.
Parker cannot get the East pilots to give the change of control. He is blocked, again. As are the West pilots and the Nicolau. That is ancient history. 2007 Wake up boys, what year is it? Still no Nic. again
