US Airways Pilots, After Long Wait, Want Payoff From AMR Merger

http://www.thestreet...amr-merger.html

"Over the years, multiple non-pilot sources have told me that Nicolau was frustrated by the conduct of these supposed leaders. His ruling seems to reflect that."

Frustrated or not, NIC was charged with issuing a FAIR award. He did not and his frustrations were reflected in it. That is why the prevailing argument is over "final and binding" and not fairness.
The problem with arbitration is the complete lack of oversight. The arbitrators operate with almost complete autonomy and have little to no fallout from their actions. But, all that being said, the real failure took place at ALPA National where they had the authority to do something and chose not to.

This is how it will go down. The street.com Dead on. The Nic, is long gone.

T Reed is a biased idiot.

Oh wait, I should have said, In my opinion T reed is a biased idiot, just like he should have said that in his opinion, (an opinion derived after and devoid of the facts that influenced the arbitrators decision ) instead of stating tha "it seems fair to say that the ruling was absurd".

What is absurd is that anyone would listen to this guy.

The Nic is a fair award that gave the east more than they actually deserved. The Nic followed merger policy to the letter, does not contain any windfall, and here is the kicker...the Nic is still,,,to this day,,,the only accepted system seniority list at LLL.

That for all you east idiots that bought Seeham's BS is what is meant by "binding"!

Now a merger seems almost here. Expectations are high. The west pilots generally want a deal, although one told me the top benefit would be "putting USAPA in the grave." East pilots generally want a deal too. But some worry that so far the airline's bargaining position has not included maintenance of their scope clause, which protects the Charlotte and Philadelphia flying that they see as the principal asset they have been able to retain through their struggles.
Some American pilots, opposed to a merger, have compiled a "date of hire" seniority list that places many US Airways pilots ahead of American pilots. Theoretically, that could enable US Airways pilots to take the best international routes from Chicago, Dallas and Miami. But US Airways pilots have no desire or expectation to take American flying, and they fully expect "fences" to protect both carriers' flying in any merger deal. As one US Airways pilot told me, "We're not looking for a windfall. We never have. We just want to protect what we bring to the party."
For this downtrodden pilot group, that does not seem a lot to ask.
That is wonderful. What a concept. Keep what you brought. Except that is not what a merger means.

Things change. The corporate boys are going to teach you a very hard lesson in sharing and expectations.

No ALPA had no authority to do anything other than present the award.

Lack of oversight? Guess you guys should have negotiated when you had a chance instead of standing on DOH and hoping for a split the baby from the arbitrator. The arbitrator picked the reasonable option

whenusapa goes away what will old Ted do? No source inside. No more biased reporting. He may actually have to do some research and work.

ALPA national decided to do something alright.

they decided to violate their DFR to the AWA pilots, and had the east been even marginally reasonable at Wye, ALPA may have succeeded.

The people who chose not to do anything are the people who voted for uscaba.

Everbody from day one has told the east, you are not getting DOH, and what does the east do after final and binding arbitration? They go on a 5 year temper tantrum still seeking what they cannot have.

the Nic is more than fair to the east, Reed is an idiot, Nicolau did not show any favor to the West or frustration with the east. this is just another east finger pointing piece for the east.

Nic, was senile, Nic was frustrated, Wake was biased, and on and on and on. How about you folks over there wake up and realize nobody is out to get you. then maybe you can quit inflicting all this harm on yourself.

The business world realizes the absurdity of the Nicolau. So do the AA pilots, as does Crandall. The Nic is an obstacle to the Wall Street Agenda. It will be shelved easily as it has no legal standing. All the risk lies with the west.... and all the harm will be inflicted on the west and the Nic. It is that simple.

The arbitrator issued a punitive award because he wanted to and no one could stop him. It was stupid, it was petty and it made an unbelievable mess.

Your head is going to explode.

He will find a way to pander to whatever audience wants to hear his drivel.

I love the way Reed downplays the "west pilots contention that binding arbitration is binding arbitration".....by saying..."although an east pilot told me that "my first marriage was final and binding too".

It is not the West's contention...it is a fact derived from the same legal system that gives that idiot a First Amendment right to publish his idiotic opinions tha "binding arbitration is binding arbitration"!

And to the east pilot who compared arbitration to marriage. did you just walk away from the marriage by changing your name....or was there a legal settlement,,,,,only asking because the West is going to collect on the alimony.

The business world realizes usapa is a bunch of disgruntled ungrateful reneging malcontents that are impossible to do business with......

So, I am thinking the business world is about to shelve the scabs to their rightful place in history.

Absolute BS...

Quit casting blame on others for your own faults.

The Nic is not punitive. The east got a great deal.

Let's take the guy who was 1000 at AAA. After twenty some odd years, he was 55years old, was number 1000 out of 2800, had lost his pension, and was about to lose his job, when along come a merger with enough money for the company to operate in solvency for his remaining 5 years. Absolute lottery win for this guy.

Then the Nic comes out and instead of being 1000 out of 2800 and done, he is now 1200 out of 5400 and golden til retirement.......oh, the "absurd" travesty of it all!!!!!

PS.....if I were this guy, I would be absolutely livid that scabs like Theur, Colello, Bradford, and others have cost me easily over a quarter million dollars, and I am still working at a rate far below my West counterpart.
