Check with your merger committee. They insisted on Nicolau. Our merger committee did not want him but our MEC chairman went around them and told the attorney to concede.

I know you won't believe this but even so, the arbitrators were chosen in a manner similar to picking a jury. Nicolau was your mc's first choice. I am sure you can find the documentation if you try or simply call one of your mc members and ask them.

Actually, he was their third choice unless the MC flat out lied to me.

You are right RES, there will not be any east class because....well why would there be?

There might be a class of reneging scabs who join together and file a lawsuit.....but that will not make them the "east" class!

Further, who are they going to sue, and what are they going to sue for,,,, the company for not kowtowing to their demands, or the APA for well ...um....kicking their ### instead of kissing it,,,,,or the West pilot class for.....um...again like the APA!!

That point needs to be repeated.

Who would east pilots sue? Their new bargaining agent for ignoring the former bargaining agents proposal? Usapa told us that is a loser and the new union can ignore the old.

Going to sue west pilots? We will be APA pilots sue them. Oh new bargains agent.

You're an idiot. All it takes to become a "certified class", to use your words, is to file a lawsuit. Plus, there is no pending order against the East saying that a judgement specifically applies to them, as Judge Sllver did to the Westicles when she amended her order. The Nic isn't going anywhere. Have you or any east pilots put together an LLC yet? Set up a trust to collect donations? Interviewed lawyers?

Btw O'Dwyer or symanski would be a really bad idea. Show up In Court with the usapa lawyers that were supposed to represent ALL us airways pilots to then sue on behalf of east plots. Provable DFR.

Find different lawyers.

Count on a retainer of about $30,000- $50,000 to start. Around $100,000 to file. If it is not dismissed right away have about $2 million waiting. If you can find a law firm to take the case. They will want a showing of interest. Then there is the part about opting out of the class.

With a new contract and a new seniority list how many east pilots want to continue the fight without the extortion I means dues?

So sue away boys. Get your plan together and start collecting money if you want to be an east class.

The only thing he disagreed with was the 300 furloued pilot recalled AFTER the merger and PID. Otherwise he agreed with the award.

Don't need a theory. Prater was crystal clear he wanted us to take one for the team because it was contract time at his pet carriers. All that after he strolled into the crew room and announced he knew the NIC was "problematic" the first time he saw it. File your suit and lets get this show on the road. It's time for this to be over and it won't be over until a judge says it's over.

Sorry, fools. The East pilots don't need to. YOUR dues are helping support our cause. Plus, there has been no shortage of lawyers, legal experts or anyone else to support our cause.
