You are a goof ball pal. Do you think that I care what any of you Westoffs think of me? I know the history of your airline and scabs that started it. I have said all along just wait and see what happens in the courts. Whatever the list is I will survive. It is you Westoffs that get hard at the thought of jumping ahead. The westerners originally were hired to scab in Australia. They had an efficient cadre trained by Wien, and were willing and able to scab in Australia. The Franke Disciples to this day are free lancers, and will fly enormous amounts of time, to further their individual motivations. Their motivations are always self serving. Look at the legions they have trained on these boards. They re write the script on seniority to serve their own personal agenda. Most of the new conscripts have been brainwashed by Orenstein, or the scabs in the left seat where the Disciples roost to train the new generation. They deny jumpseats to the easterners, over and over. Disgusting.
Now they want to re write seniority, of course it serves them. Remember- the Franke operation dwelled on the bottom for years, and went through two bankruptcies. They crow how they saved you, they lie. They destroyed the industry, the industry now has been brought to the Franke model, with no pension. The westerners originated the low level model years ago. Next time you ride the van with one of them, ask them if AWA was their first choice in aviation. They will squirm uncomfortably in their seats.

The Ninth effectively said what you just said in paraphrase form; that is, ripeness on a DFR suit occurs at the time the CBA is ratified and not before. But the legal requirements for ripeness are substantially different for a Declaratory Judgement matter. A DJ already presumes that actual harm or a breach of duty does not need to have occurred yet but still creates a situation where a party needs and is entitled to judicial relief. Therefore, Silver does not need to wait and see what USAPA and Management will achieve at the bargaining table to determine if there is a valid expectation of injury to the Company or to the west pilots. As she put it, this case is exactly why the DJ statutes were created in the first place. Thus, while she may not lose any sleep over this matter, she has the full legal authority to evaluate the prayer for relief and rule for one of the Counts presented to her. If she determines that Wake and the Addington jury were correct, she could rule in a summary judgement on Count 1 without a TA/JCBA being ratified. Seigel is a smart guy and a recognized expert on the RLA. He has laid all of this out for Silver which should make her decision exceedingly easy if she follows the undisputed facts to their already determined conclusion.

That is not quite what the 9th said.....what they said was just in our specific case currently in front of them, the DFR is not ripe until a CBA is ratified....not that a DFR is never ripe until ratification. That is the biggerst part of what is mind bogglingly stupid about their decision.

The easterners reward their scabs with union positions. One speaks for their union and the other represents them.

What did that year at Mesa get you but the attitude? Perhaps furloughed and listened to the advice of Leonidas that told you not to accept the recall? Now the eastern division must hire. I saw the unfilled positions in DCA and PHL. New hires. Nothing on the western front but despair. A westerner who passed furlough into this merger is totally hosed. Nice job Ferguson. Good advice. Now all recalls will be AA.

After all, the east has had the biggest WINDFALL of all with the latest merger. They've kept all of there seats and and gained by any measure compared to pre-usair bk/2005 and still they're not content without stealing from the west with there doh illegal mantra.....WTFO?? (B757,E190,A330 seats)

I say....let them sulk/suffer on loa93 longer...because there's no fixing usapa = ustupid!

Certain places east pilots don't like to be....Is in front of Federal Judges and Neutral Arbitrators explaining themselves with past UNION corrupt actions.

In one of the few things I ever called right, I knew we were going to end up with usapa. The way alpo tried to strongarm the west, yet not go so far as to do anything 'to' us without our consent, only served to piss everyone off. The east because they weren't doing enough, and us because of the sleazy way they went about mollifying the east when it was them who pulled out of JNC. Not to mention usapa had a carrot that I figured many east pilots would be unable to resist.

I cringed when I'd hear some of our west guys say stuff like 'they don't have the cards...' etc. I remember thinking to myself, you sure about that chief? I dunno. Anyway, even though I was royally pissed off, I of course did vote for Alpo, and even manned the call center.
 
In your world, can you understand, usapa may not exist in the near future? Are you willing to fund your illegal quest going forward?

I've a mechanism in place (known as AOL) to sue the current cba now called usapa or any other cba. (alpa, usapa, apa, lcc/company, ect) If they don't enforce and honor my TA with a joint contract with THE COMPANY of which I paid for and I am entitled to....

Your like sitting on the fence/I voted for alpa buttttt pi brat stated earlier...word's to the effect....it's all about meeeeeee, because I have gained at someone else's expense and go along/agree with usapassss's CORRUPTION!

Hopefully soon, the wicked witches of the east will be DEAD known as usapa and supporters of such easties union corruption.

Let's briefly examine the key elements of the operative philosophy exhibited = "I've"..."my"..."I paid for"..."I am entitled to". Whew!...Ok then. 😉

This is, of course, immediately followed by projecting onto others their supposed notions: "word's to the effect....it's all about meeeeeee" 😉 Small wonder nic "makes sense" to some at least...and is naturally "fair and equitable" to boot.

Little point in much addressing the infantile pathology inherent in: "Hopefully soon, the wicked witches of the east will be DEAD known as usapa and supporters..." There's just never a dull moment in the little soap opera hereabouts...
