It's not so much politics as it is judicial philosophy. Judges come in 2 basic flavors, Activists and Constructionists. where it gets politicized is that Democrats usually nominate Activists judges and Republicans nominate Constructionists.

If the judge in this case is a constructionist and Dr Lee's theory is not widely accepted as scientifically valid, US could be in a world of hurt as a Constructionist judge will not give it much, if any weight.

Conversely an Activist Judge may view this case in light of an overall imbalance between Labor & Management and decide to judicially correct that imbalance by not giving certain testimony the weight it deserves.

If Dr Lee and his theories are widely accepted and the judge is a strict Constructionist, USAPA will be crushed and I mean ground into fine particles.

If Dr. Lee's theories don't take into account the center runway closure in Charlotte and the associated longer taxi times plus the effects of weather, then they also could begin to look like Swiss cheese. We'll know more Monday.

I would say that when a sitting federal judge has to be told by the appeals court what "ripe" means, that's being spanked. I would figure most district court judges that went to law school already knew that. Evidently, Wake didn't
