Temporary Injunction against USAPA filed today

Well, there are several communications from USAPA stating just that. What are they supposed to do? Hire private detectives? Covertly grab the culprits and ship them to Gitmo for some water boarding? Hire snipers and have them shot? What?
The court does not have to tell USAPA what to do or what they should have done. The law requires the CBA to ensure that the status quo is maintained and the court will likely order USAPA to return to status quo conditions or face the consequences of an injunction, possibly with fines. Courts don't tell CBA's how to maintain control over their membership just like they don't tell Management how to run an airline. They simply order them to operate within the law if they have been found guilty of not doing so. I presume this will all be clear in rather short order.

Now, what should USAPA have done? Well, of course they shouldn't have violated the status quo under the guise of a safety campaign for the purpose of illegitimately gaining negotiating leverage. Furthermore, they should have taken the company's cease and desist demands seriously and stopped the illegal job actions. Then, if certain pilots still did not fall in line with the law, USAPA should have worked cooperatively with Management to determine which flight crews were responsible for the illegal conduct and taken any and all disciplinary steps required, including termination, if the conduct didn't stop. If USAPA had done that, then this would not be a matter before the district judge today. Of course USAPA did nothing to ensure the status quo wasn't violated and time will soon tell what that means to every east pilot, both those who participated in the illegal conduct and those who may not have. Popcorn anyone?

Another beat down of the pickleballers. Cleary was smug, evasive and incompetent. Of course there was no magic witness that saved the day as was so predictably claimed. That is the uslappy M.O...make wild overtures as to a major victory always just around the corner. Those claims ALWAYS end in meteoric failure. Are the aol guys in prison yet? :lol:

The Judge is going to bend Cleary and his merry band of idiots over. Once injunction in place Kasher will release loa93 loss as well. Of course uslappy will just double down and ignore the injunction. That's where this is going to get REAL fun.
 
I truly hope that US Airways loses this case. It's time that someone puts a stop to these corrupt managers and executives, and teaches them a lesson - as small as this one might be.
 
There is going to be no injunction. This judge is not like the Arizona Right Wing Wake Circus. There actually is a decent legal system in N.C. and this judge is part of it. Both sides are getting a warning to work together. Not that they are capable of it, but the mandate will be given. There will be no smackdown as Koontz and the Leonidas anarchists think. Good luck to all who work in this place. Everyone is going to need it. As usual, the place runs on and on with no adult supervision. That, is readily apparent.

These guys are such hypocrites. When they think they have a case against the west they scream from the roof tops for a quick execution, before there are even formal charges, let alone a trial and a conviction. But when THEY are the ones accused of wrongdoing they play the "innocent until PROVEN guilty" card.

In this case they all assume there has to be a smoking gun, as if this pending injunction must meet the same standard of "beyond a reasonable doubt" as in a murder trial. If the union was made aware of the problem (which they were) and did nothing to stop it (which they didn't) the injunction will go forward. USAirways has far more evidence against USAPA than UA had on ALPA, and we all know the outcome of that.

I was told Dr. Lee's report did not take into account runway construction in CLT or weather. I truly don't know, but if it doesn't, it can't be very accurate.

The express side actually turned in the worst performance and most write ups. Looks like the dream injunction is slipping away, just like every other effort the failed Team Tempe tries.
