TWU Chapter 11 - AA 1113 Filing

Was not long ago we were being advised to get a 401K loan and keep the funds available to prepare for a strike.

Now we are "hoping" to get the company match on prefunding from a Bankruptcy Judge.

AMAZING, we should make a movie!

I couldn't make this stuff up with my shallow imagination.

Almost as entertaining as the AMFA Drive and going to TWU Kangaroo Court.
 
Until there's a ruling, I wouldn't count on getting the company's contributions.

Legally, the company can't hold onto the employee's prefunding contributions + interest, but if the contract can be abrogated, so can the 1992 agreement covering prefunding.

Historically, I don't think non-union groups have fared as badly as the unions when it comes to concessions. As you said, the company can already do whatever they want. It's a fact that agents lost less than anyone else at AA in 2003. How the pm-NW folks were treated is another story, but DL must not have treated their non-union employees all that bad, otherwise they'd have voted in unions during the last round of representation votes....


If the company can raid a trust fund,there is no limit.The match plus the contributions are held in a trust, It wouldn't surprise me though after reading about the Judge. These courts are bought and paid for by Big business just Google and read the history... What's to stop them from Raiding a 401K match down the road? Match it with worthless stock? It all sounds good til the stock is worthless..This is nothing more than a Bernie Madoff scheme...
 
They cannot take your matching funds for your 401k, been through two bankruptcies at US and thats illegal, its not in a trust, its in your account with whomever administers your plan.

Ours was Fidelity.

Well your two bankruptcy experienceat US either doesn't give you the ability to read and comprehend or you dont know our CBA.
We are discussing the pre-funded retirement medical trust accounts not our 401K accounts. The prefund retirement medical account is administered by the same company administriring our 401K's.

And yes their is a trust, and here is what our CBA has to say about

(n) Prefunding Trust (Memorandum of Understanding Between American Airlines,
Inc. and Transport Workers Union of America AFL-CIO, April 02, 1992)

Article 41(n) expresses the understanding of the parties regarding the amendments to
the Trust Agreement and Plan effective January 01, 1993, governing the health benefits
provided to active TWU represented employees of American Airlines, Inc. at retirement
and the health and other welfare benefits provided to retired employees of American
Airlines, Inc. who were represented by the TWU at the time of retirement.

Article 41(n) will not be construed to modify or alter an employee’s eligibility for retiree welfare
benefits under the collective bargaining agreement or the Plan.

(1) The Trust Agreement and the Trust which holds Plan assets is established
for the exclusive benefit of TWU represented active employees and retired
employees who were represented by the TWU at the time of retirement.

(2) The Trust will maintain a separate account to hold reserves equal to the
Participants' prefunding contributions, Employer prefunding contributions, and
investment earnings attributable thereto reserved for retiree welfare benefits due
to Participants under the terms of the Plan and to pay administrative expenses
associated with such Program. In the event of termination of the Plan and/or
Trust, the balance of the reserves will be distributed as provided in
Article 41(n)(8). In no event will these reserves be used for payment of any expenses
associated with the active employees medical benefits program or for any other
purpose except those identified with respect to retiree welfare benefits in Article
41(n), the Trust Agreement, and the Plan.

(3) An employee participating in the Retiree Prefunded Benefits Program will
make a monthly contributions to the Trust Fund. If an employee was an active
employee of American Airlines on December 31, 1989, and elected to prefund
when first eligible, his contribution was $10.00 per month in 1992, and such
contribution amount is subject to the Escalator, described in Article 41(n)(5), in all
future years. If an employee was not an active employee of American Airlines on
December 31, 1989, or was an active employee of American Airlines on
December 31, 1989, and declined participation when first eligible, his contribution
amount is determined based on the age at which he begins participation in...

Please refrain from being so in a hurry to tell us how many Bankruptcies you have been through that you cannot even keep up with our conversation topic.
I keep saying that your experience is not going to apply here, and here we have another example of why.
You can have all the experience in the world. but if you cannot keep up with what we are discussing, you are going to misguide many very concerned folks that need the facts.

I have no inside information, but given the time frame of the justice system, I would expect to see the 1113 "ask" within the next two weeks.

If you go to the amrcaseinfo and look through the info there especially the Case Docket, I believe you can gain an understanding as to the case time line. However that does not actually mean that the unions are not discussing issues outside of the site.
