Wow, I haven't been here in months. Not one thing has changed, same old post from the same posters. I'll check back in a few months, and I'm sure not one thing will have changed.

I'm wondering why the west guys have not filed the lawsuit against ALPA... they sat on Nic for how long???????
Hard to make a case for damage. Don't worry though, the ex-TWA pilot's suit against ALPA is progressing nicely.

No need to comment on that until something actually happens.

You may be right... The point I was trying to make is the vultures on this board seem to whip into a frenzy anytime something like this comes up. Frankly I was surprised I did not see any comments...

Trust me! There is no love lost for ALPA out west. The difference between ALPA and USAPA, which is what you are getting at I believe, is that ALPA never made the promise to toss a final and binding award. But then that's just my simple opinion...

There are much smarter people on these boards that could provide a better explanation I'm sure...

"The West Pilots do not have an adequate remedy at law for future
damages that will accrue until Defendant US Airways and USAPA comply with their
contract and representation duties because there are too many factors affecting any
calculation of their likely damages to make such calculation practical."

Honest question, I read that as 6 plaintiffs throwing the rest of the West group under the bus?

Of course you would! But I think a better reading of the suit would suggest that the "rest" of the west pilots, of which I am one, just want what was fair, the Nicolau award to which the east agreed (yes I know you didn't get to vote... So on and so forth.). As far as the "6", I believe they deserve to get what they can! I would have to assume they are the ones who did the leg work. Good for them!

Yep..and has been "progressing nicely" for how many years now?....Is it 9 years now?...and the MDA action's going on 5, with no end yet in sight for either?....Yawn.

Don't get me wrong there. I feel that the TWA and certainly MDA people were completely sold out by alpa...(big surprise all around....Not) and should have sued. I hope they ultimately both win. The point is that any such litigation, even if found to be of any merit, and regardless of any likliehood at all of eventual success, takes many, many years....which may explain the lack of concern, or even much interest yet shown on this thread towards the AWA actions noted.

Meanwhile..back at the ranch...etc.
