I read somewhere Jim Little can use executive power to pass this if he feels it is in our best interest. No International president has ever used that power but I hear he can. Thoughts?

There was a suit filed after the 2003 football bat contract - the outcome essentially said "He can do that, brother". Talk to Chuck Shalk about this as he was involved.

As I understand it, the suit's outcome effectively gave (or affirmed that) little jimmy had the right to sign off on our contracts as they are owned by the international, not the twu membership.

This came about after Carty was "caught" establishing a $46 million slush fund to ensure the top execs didn't have to make do without their lavish retirements, should a bankruptcy occur. All three unions were told the voting had to be completed by a certain date as the next day was the drop-dead date for filing the quarterly report with the SEC that would have detailed the slush fund and other onerous additions the company or "union" didn't bother to tell us about. That's the primary reason, In my opinion, the company demanded the confidentiality agreements of them, not because of any sensitive info in the books.

This all came to light after the F/As screwed up some part of their voting proceedure and had to have a few extra days to get 'er done.

Even though Carty was chosen to fall on his sword and a pittance of stock given the twu membership as a "mea culpa" by the company (after little jimmy raised hell for appearance's sake), he signed off on the vote, even though the majority wanted a revote due to Carty's supposed dishonesty - Carty would have needed the approval of the AMR Board of Directors to establish the slush fund and was doing as instructed, not acting unilaterally as the company and all three unions would have had their memberships think - all three were complicit in the fraud.
 
I hope he respect the vote and do not impose an offer without our consent.
 
If he did accept without ratification, he'd essentially guarantee a de-certification vote. There's also a remote chance that the judge could call him out on accepting something the membership rejected, or individual members could file a motion to dismiss what amounts to ratification without ratification...

Or he could let it be voted no, and claim that the membership had spoken...

Which of the two do you think he's really going to do?...

Someone found plenty of dead and retired individuals eligible to vote in another election some years ago, effectively denying us a vote on representation because not enough authorization had been signed.

Do you really think any election would be allowed to occur regardless of any "indiscretion" by little jimmy?
 
What are you AA guys waiting for? Get rid if the TWU and Little. There are way better unions out there. Don't let the TWU Fear you

That is the fault of whoever, or whichever union, ran the card drive. A large business is a dynamic organization that doesn't stand still while authorization cards are being gathered. People retire, die, leave, get promoted to positions where they're not allowed to vote for/against representation, get hired, etc all the time. Anyone or any union gathering cards that tries to get by with just the minimum required is dumb.
