The latest letter from Marty Harper to USAPA, was that meant as a joke of some kind?

As former AWA pilots, it is nothing short of a miracle that we have survived to this point given the nearly continuous attacks on our careers at the hands of USAPA. But, we are still here and we believe we will not only survive, but thrive as part of the New American. This opportunity only exists today because we have had the Perseverance, Unity and Courage to stand together and fight against overwhelming odds and an immoral adversary who lacks any shred of integrity. This, while that adversary has used our money to defend themselves while concurrently taking overtly hostile actions against West pilots. Yet, we're still here and still strong. With all apparent odds in its favor and virtually unlimited funds, USAPA failed to put an end to our resistance. Instead, we have taken the fight to them at every opportunity.

This election will likely be the last in Phoenix under USAPA, and like everything else the West pilots have done, it will shine in stark contrast to the pitiful, shameful and questionable elections and campaigns found out East. Why? UNITY!

There are six candidates vying for three positions in Phoenix, but you won't witness any of the pathetic antics displayed in every East election to date. It's simply because we all stand for virtually the same platform and only offer subtle distinctions as to how to reach our ultimate goals. Choose any three based on your personal preference and rest assured that we will work diligently to FINISH THE JOB during the final days of USAPA.

Future messages will outline some of those distinctions amongst this field of candidates, but we wanted to offer this message first as we share the common goals of defending our seniority, protecting the rights of minority groups within a union, holding USAPA and management accountable for their actions by all available means, effectively defending our pilots in discipline and grievance matters, and advocating for the concerns of PHX pilots before the BPR and Officers. And, we will do all of these things with forceful dignity and unquestionable integrity simply incomprehensible to our adversaries. We will not be trod upon!

This may be the final opportunity for the West pilots to display our solidarity and resolve in an objective, demonstrable fashion through the election process. Voter turnout is critical to show management, East pilots, and the APA that West pilots will not be left behind this time and that, together, we are a force to be reckoned with. Furthermore, it will demonstrate that our former AWA pilots easily outnumber any of the various, warring East factions. We must affirm this yet again to remove any doubt!

Yeah...Why, merely the incoming missles alone must have been terrifying for them during all the "continuous attacks"! Sigh!...It must just be a mighty "spartan"/drama-queen thing that we'll never understand, and must simply find both wryly amusing and just-plain hard to even believe.

Umm...Help us out with this snapthis. Since, by your estimation, usapa's now entirely "moot", and has no say in anything anymore...well...where's the possible importance or even slightest concern with what reps are in place out west (or anywhere else) to be seen? 😉

Umm Hmm. Who could doubt that the APA's not properly terrified by "you'se" imposing strength in numbers..?....Seriously? 🙂

It's both interesing and very telling indeed that you would so quickly project that on others, especially since you can't possibly quote so much as a single post from any east pilot making any assumptions towards the 777's that are correctly of the American pilots turf. On the other hand; how many times have we seen posted west pilots loudly and arrogantly boasting that they'd soon take A330 seats from the east? What "you'se" posted there speaks volumes only about yourself and the west.

Kim Jong-un reportedly executes blood relatives of once-powerful uncle as purge continues

North Korea ruler Kim Jong-un has reportedly ordered that all blood relatives of his executed uncle be put to death, continuing an apparent purge of all he sees as threats to his reign.

South Korea's Yonhap News Agency, citing multiple sources, reported Sunday that "extensive executions" of relatives of Jang Song-thaek had been carried out.

"All relatives of Jang have been put to death, including even children," one source told Yonhap. Among those reported dead were Jang's sister Jang Kye-sun, her husband and Pyongyang's ambassador to Cuba, Jon Yong-jin, and the North Korean ambassador to Malaysia, Jang Yong-chol, a nephew of Jang, as well as his two sons.

In addition, Yonhap reported that the sons, daughters, and grandchildren of Jang's two brothers were executed as well.

International Association of Machinists and Aerospace Workers (IAM) and eight flight attendants (individual appellants) for Trans World Airlines (TWA) appeal from the district court's denial of their motion for a preliminary injunction against the Independent Federation of Flight Attendants (IFFA), an unincorporated labor organization. Because IFFA has no representational responsibilities on behalf of the TWA flight attendants, we conclude that IFFA is not entitled to retain funds that reflect union dues paid by the flight attendants beyond those necessary to conclude representation. Therefore, individual appellants are entitled to a preliminary injunction. We reverse.

Prior to March 6, 1997, IFFA was the official collective bargaining representative of the TWA flight attendants. These attendants were the only group IFFA represented and, consequently, IFFA's sole source of union dues. Additionally, IFFA's only collective bargaining agreement was with TWA. In the fall of 1996, IAM submitted a bid to merge with IFFA. Sherry Cooper, president of IFFA, supported the merger but IFFA's executive board rejected the bid. Subsequently, IAM sought to become the TWA flight attendants' sole collective bargaining representative. With the help of Cooper, IAM acquired IFFA's membership lists and mailed materials urging the flight attendants to execute authorization cards that would allow IAM to seek a representation election with the National Mediation Board (NMB). After receiving sufficient authorization cards, the NMB scheduled a union representation election to be held on February 27, 1997.

Shortly before the election on February 21, 1997, the individual appellants sent a letter to IFFA.1 Pursuant to the Labor Management Reporting and Disclosure Act (LMRDA), 29 U.S.C. § 501(b),2they demanded "an immediate accounting of the current funds and assets of IFFA" and "that no further funds or assets be expended and that they be held in trust for the benefit of TWA flight attendants pending the outcome of the representation election."3 (Jt.App. at 344.) Also on February 21st, IAM sent a letter requesting that IFFA safeguard its assets as [128 F.3d 691] well as "cooperate in an orderly audit and transfer of all assets and records to [IAM]" after the election. (Jt.App. at 345.)

We further direct the district court to order IFFA to transfer the remaining funds to IAM as trustee with the duty to return the funds transferred to the flight attendants who were former members of IFFA pursuant to a formula to be devised by IAM as trustee and approved by the district court."
 
Having said that, USAPA DOES have what I would call a "wind down" provision in its constitution and bylaws....which IFFA DID NOT.  
 
You guys have to read the WHOLE CASE.... not just what you want to cherry pick to make it like you are going to put some kind of "whupa$$" on USAPA.

When APA replaces USAPA will USAPA return all dues money or not?
 
If not how much will it keep?
 
Will that money be placed in escrow with APA for the East MC?
 
Does USAPA's C&BLs trump case law?
