That's right guys/gals, don't listen to me, or Silver, or the company, or the APA, just keep reaching.

The west lost in her courtroom, the company's not the determinator of seniority integration, and I've yet to hear so much as a single actual reason the APA might at all have for wishing overly-inflated seniority be granted to a west minority, that'd only serve to disadvantage their own people...?

And don't forget it was the America West pilots that put our company in a position to acquire American and preserve their jobs.  And tell them they are welcome!
America West pilots were part of a company who pulled themselves out of bankruptcy which put the company in a position to acquire US Airways. It's called restructuring.

American had a plan.

Parker had a plan.

What was US Airways plan in 2004?

Headlines read.......
"And so far, there's no sign that a major new investor will step up to save the airline, as happened before."

"But the airline's future will hinge on a financing plan some experts called precarious, staked almost solely on limited cash reserves with no additional financing in sight or assets left to put up, according to documents unveiled yesterday."

Sep 12, 2004 - Mr. Lakefield said the airline had to seek bankruptcy protection so that it .... a move could quickly put the airline in liquidation, since investors were not likely to put money in the airline.

Who stepped to the plate?

"A longtime Phoenix lawyer and community leader, Richard Mallery, played a role in the high-profile public-private restructuring of bankrupt America West in the early 1990s and watched the airline go on to acquire US Airways....."

"The reverse takeover structure of the America West/US Airways merger was different than past mergers. Simply, America West purchased US Airways, but the US Airways brand remained dominant while Doug Parker became the CEO of the combined airline."

What was Lakefield's role in the merger with American?

How did America West pilots win the lottery when the risky acquisition of US Airways could have cost their jobs?

Oh wait....it happened but it was called a furlough.

Some lottery ticket.

Yes... by the slimmest of margins... Can you tell us how close we came to the edge of the wide range of reasonableness?  Exactly how close to the edge did we come?  Exactly how much further can we still go?  We can always go another half way to the edge...  how much is half way to the edge?
That is simply brilliant.  It sounds like your plan is to keep walking until you fall off the cliff.  No wonder you guys don't take warnings seriously.

"You'se" can't possibly mean that the mighty "Shield of Leonidas" failed to actually "Protect" anyone?

Wanna bet?  There will be no displacements and no bumping or flushing.  Those were requirements by the company for any SLI agreement.

Besides, you guys lost.  Pretty funny that you guys apparently went crying back to Mr. Freund after you fired him for telling you the truth.  I guess that after Marty dumped you all for not paying your bills you had to do something.
So....Marty told you he quit because of non-payment? That's news to me.

Sounds like wishful thinking

Silver never once quoted the SCOTUS standard of DFR. Not once. She barked real loud and followed the law, twice! She is as good a politician as she is a judge.

Says the young fellow who fails to heed COURT DECISIONS, and instead postulates the intent of judges ruling against him, twice. Failing to read an actual decision, instead daydreaming what a judge might or might not be thinking. Especially judges like Silver and Wake, who were the ones swerving, because they did not know labor law.
Take the decision seriously Bean, because it carries more import than a judge throwing out a biased "warning" that carries no legal weight.
Keep listening to Eric Ferguson, who actually missed his calling and should really be a television evangelist or car salesman. He has no business telling you anything labor related. Keep listening to Marty Harper who took two unripe cases for millions from you.
I will take legal decisions over your warning interpretation any day.
Face it, Leonidas may be holding a shield, but his pants have been fallen down around his ankles for years.

Tell your pal Snappy and Nic4 to show up facts sometime or shut up about it.
I will shut them down every time with the 10 k while NoNic4 and Anger will bring a news article.

I produced the legal document, the 10k, you produce the headlines. I can produce a headline saying Dewey defeated Truman. Put up or shut up Snap. You can't. Go listen to a huckster named Eric Ferguson. Mike Cleary took his troops through the war and defeated Leonidas. Ferguson took 3 million plus and lost.
Cleary beat you completely, as everyone knew he would. And that pisses you off totally. Nice.

Question for Snap. Tony Anger being the huge patriot. What branch did he serve in? Or is he a poser biker and poser patriot too?

I have a question for East and West Pilots.

Does either or both your CBAs have the same language as all three IAM CBAs, the CWA CBA and the AFA CBA that permits you not to cross a sanctioned picket line at US property?

Never saw it in our east agreement. Don't know about west or AA's.

This is the language in five of US' CBAs,

The Company will not require the employees hereunder to cross picket lines of the Company's employees legally established under contractual provisions and the Railway Labor Act on or in front of the premises. The individual or concerted refusal to pass such picket lines shall not constitute grounds for discipline, discharge, lay-off, or be considered a violation of this Agreement.

Not only are RTO's discussed in the news but in the classroom as well. Case studies have been completed and the following thesis is a good example. I think it would be safe to say that Duke is a respected university.
