Ummm, I believe she said USAPA didn't have to, not that it wasn't possible.

Silver said the statute does not entitle the west to a seat and USAPA did not breach it's DFR by abandoning the Nic. Any hope that APA would actually do anything to disadvantage themselves in the SLI is a bit of a stretch.

APA is making moves, as well as the company, to assure a west seat at the table. That's quite obvious. Negotiations are at an impasse which means they're over. Neither side is going to give and time belongs to the APA. All that's left is the NMB and, per Silver, USAPA is separated from SLI and decertified. APA takes over and appoints west (who introduces Nicolau) and east reps of their choosing.

This is how it's going to happen. There will be no protocol agreement. USAPA is being slow-rolled. Freund sees it coming and parted with USAPA and is now retained by the west.

Not looking good for USAPA.
Then the East will sue and the whole thing will be tied up in court for years. Works for us here on the east.. the attrition train is rolling down the tracks.

Give it your best shot. The APA and company lawyers have already considered that possibility/liklihood and decided another West DFR suit is the only one with merit.

Frankly, I don't think the East has it in them to organize and fund a suit. I betcha Lee $eeham is available if needed.

Sue? Your dreaming. A lawsuit won't stop integration and will take years if it ever gets off the ground. And the company/APA will outspend USAPA. Or do you plan on becoming a little Spartan?

There won't be any lawsuits. USAPA is nothing but bark.

Agreed.  The east is on their last play, their only strategy these past six years having been delay, delay and delay.  Since the east never submitted an official proposal for seniority the only list that the company and arbitrators have to reference is the Nicolau list.  The east can submit their proposal to the arbitrators but that will carry little weight since USAPA is not going to be a union, just a group of disgruntled, angry fo's trying to evade a previous agreement.
Arbitration is set up to be respected process, what the east has done to this process as well as denigrating and slandering one of the most respected arbitrators is about to come back and haunt them.  This will be fun to watch.

Sure be nice if everyone would stop talking in riddles and tell what is really going on with the protocol agreement...
I think we'll have to wait for the APA update. I suspect it will be the only straight story to be found.

Name just one time when any pilot group was timid in an SLI negotiation because of the threat of a lawsuit, just one.... APA is shaking in their boots, not. APA won't do jack with any threats of a lawsuits from anyone. They will press on toward what is best for them without regard to threats, accept perhaps appear to play along with threats to the extent it helps them leverage negotiations. YMMV.

What riddles? Extended deadline came and went. Two hang ups were a west seat and USAPAs place once APA became CBA. Obviously APA didn't budge so nothing was agreed to.

Now APA waits for the NMB and USAPA disappears.

In politics there is never "the whole truth and nothing but the truth." At least I haven't ever seen it yet. 😀

What does the MOU say about disagreements over it's implementation? Perhaps you should read it instead of getting your info from the AWAPPA board.

Why should he bother to read it...He is paying good money to have others read it for him. "They" have it covered! 😀

System board? LMAO. By the time that gets back in 2 months any decision will be moot as USAPA will be gone. You on the AWAPPA?

We'll see. Of course your crystal ball has been so finely tuned through out all of this, I should just listen to you.
