In my opinion, USAPA sued APA because you intend to retroactively change the protocol agreement once the NMB declares SCS. You also intend to control the former USAPA merger committee, as in staffing, funding, etc. I have further heard, but cannot prove, that once USAPA is decertified, APA and AAG will modify the MOU to remove para10h.
IOW, it became clear during protocol talks that APA intends to run the table once SCS is declared, using vague language from the MOU and Silver's predictions and prohibitions concerning future events as a justification. That is not the intent of MB.
