US Airways Local Council 41 Put in Trusteeship
Executive Council votes unanimously to remove officers for failing to provide necessary support to ALPA

The Executive Council voted unanimously today to take “emergency corrective action” by placing Local Council 41 (US Airways, Philadelphia) into emergency trusteeship.
 
The vote terminates the terms of Capt. Eric Rowe, chairman and captain representative; Capt. Dave Ciabattoni, vice chairman and first officer representative; and Capt. Jim Portale, secretary-treasurer. ALPA President Capt. John Prater appointed Capt. Clyde Romero and Capt. Jack Lawrence (both members of Council 41) to serve as trustees of Council 41.
 
The president instructed the trustees to fully represent the pilots of Council 41 in all matters pertaining to their membership in ALPA. The US Airways MEC will continue to make all decisions concerning the affairs of the US Airways pilots.
 
Although no hearing is required at the Executive Council level, the Council offered the three former officers the opportunity, which they declined, to make a presentation, either in person or by telephone. A full hearing before the Executive Board will be held within 30 days to formally consider the charges and allow the three former officers to present their views.
 
The Executive Council found that the three local council officers demonstrated a pattern of support for a rival union in the upcoming NMB representation election, including distributing anti-ALPA communications through ALPA channels and failing to provide necessary support for ALPA in connection with the NMB representation election.
 
The president asked the three former officers specifically to confirm that they support ALPA in the representation election, that they oppose USAPA in the representation election, and that they will urge the Local Council 41 members to vote for ALPA. None of them would make such statements.
 
Why now?
Simply put, the Council 41 officers have consistently failed to confirm their support for ALPA in the upcoming election. When asked by Capt. Prater, the three officers failed to say that they stood behind their union and support a pro-ALPA vote.
Last Friday, Capt. Prater sent the three Local Council 41 officers a “Notice of Charges and of Executive Council Meeting to Consider Charges Pursuant to Article XIX, Section 1.D.” The Notice was the basis for emergency corrective action in the form of a trusteeship as provided in Article XIX, Section 1.D of the ALPA Constitution and By-Laws.
 
Capt. Prater requested the Local Council 41 officers send written statements to Vice-President Administration Capt. Bill Couette making clear their support for ALPA and opposition to USAPA in the NMB representation election, and their commitment to urge Local Council 41 pilots to vote for ALPA. While they did email a response to Capt. Couette, they failed to make the commitment to state their support for ALPA and against USAPA.
“Many of you have urged me to take this action for many months,” Prater wrote the Executive Board on Friday evening. “I had hoped that these three elected officers would stand up for their union. However, with the NMB representation election for US Airways pilots beginning on March 20, the stakes are too high for US Airways pilots—and the actions of these officers far too hurtful to our union—for me to delay further.”
The last hummel minority type situation trying to go against the majority.  Your last chance to be part of what you were not when USAPA was elected.  There is so many lethargic appeasement votes allowed one weak person, you have to stand up for once in your life.

Remember when the company said they could go ahead with the merger with out the East pilots blessings,  that was false.  Did the APA pilots stand up for you then, no.  They will continue to do what doug says to save their sorry behinds in the future.

At the request of APA, the three parties to the MOU (USAPA, APA, and the Company) agreed last week to an extension of 30 days to complete the Protocol Agreement.  This extension is only for completion of the Protocol Agreement and does not affect the rest of the seniority integration timetable.  The additional time will allow the parties to complete the process without the pressure of an artificial time constraint and adjusts the schedule to allow for the fact that much of the original 30-day period fell over the holiday season.  The additional time may also allow various legal and political issues to resolve themselves so USAPA and APA can focus on the negotiations and put the process back on track.
 
As we previously stated, your USAPA Merger Committee is committed to negotiating only with the parties to the MOU.  The goal of the USAPA Merger Committee is to reach a fair and equitable Seniority List Integration (SLI) that best serves the interests of ALL US Airways pilots.  The entire Committee, both East and West members, are in agreement that this is the most effective way of representing our pilots.
 
We are also waiting for a response from the Company to the grievance filed last week concerning the Company’s violation of the MOU by negotiating with a non-MOU party regarding the SLI and by failing and refusing to provide the Merger Committee with information necessary for it to effectively represent our pilots.  The grievance (MTA #2) is posted in the Grievance Library and our most recent letter to the Company is posted here.  We have asked for an expedited hearing (January 13-15) on the issues and will keep you informed of developments.
 
Our legal team will be responding shortly to a “Notice of Events” filed by the litigants in Addington II and the response will be posted on the USAPA website.  The only legal merger committees that exist under the MOU and McCaskill-Bond process are the USAPA and APA merger committees.  The MOU clearly defines the parties and the process.  USAPA and the USAPA Merger Committee will vigorously oppose any attempt to either undermine USAPA’s status as the exclusive bargaining representative for US Airways pilots or to weaken our position in the SLI process by dividing our pilot group.

You have never once, not ever, argued in favor of a position that strengthened the hand of the pilots of the seniority list on which, much too your own chagrin, you find yourself on.   Did you miss Unionism 101?  😀
 
Take heart, if you ever lose your job flying, you have a special, employable skill... Since you have such a propensity to immediately seek and find things others normally find less pleasant, you can be in charge of finding the fly shitte in pepper, salt in sugar, and used beer in new beer.  :lol:

Agreed.  Well...I did some due dilligence and proper research there already = "Wanted. Self-loathing-deprecating white boy, without the slighest sense of personal or ethical worth. Good call by USAPA on not attending the first meeting. It was a setup where the company tried to get USAPA to voluntary meet with an unauthorized party to the MOU-The fabricated and mythical West Class.
Now that USAPA called them on it, they are going to have to back off a deal they knew had no status or legal footing. Parker and Siegal realize now that if they want their deal to fly, they need to abide by NMB protocol.

The fact the company is providing absolutely zero support to the mythical "West Class" speaks volumes.
Leonidas just had notice served Parker is walking. His bluff was called. He can tell his West pilots he tried, but.......

If I lose my flying job I plan on spending the bulk of my time on the couch posting emoticon laced messages on an anonymous webboard.
