No matter how low the chance of success, as long as a lawyer has a stream of cash coming in to support his yacht,  he/she will continue to litigate. 

 
Indeed, but you and I've seen enough, and are sufficiently umm..."long-in-the-tooth" (to put aging kindly), to understand how the real world and human race actually works. My caustic advice was intended for such "spartans" as haven't even come close yet.

No matter. This is being played to a group who's sole "defense" against the terminology of the MOU is one of supposed, wholesale illiteracy. 🙂 These people of of the "calber" that claims being misled during roadshows/etc, who pretend to being (or perhaps actually) unable to individually even be able to READ, much less THINK, and thus?...Well...are the proper victims of such complete fools as they've chosen to mindlessly follow for years now. Bottom Line? Any that didn't/couldn't readilly read their "leadership" as obviously being infantile halfwits had to be such themselves.

I have to say that I would feel I lost if I were a West pilot, but I also feel we all lost when I suddenly realize that it seems politicians have been masquerading as judges, writing long winded opinions that keep hope alive to both sides, apparently to supply chum and baits to be used by lawyers, to perpetuate and expand all their august halls of learning and institutions that promote such arts of acceptable exploitation.    Barnum said "a sucker born every minute"....  Some circuses are more elaborate, and costly than others, even to the point some may not know it was truly a circus.  
 
If the judges had simply written their "IT IS ORDEREDs", without all the "everyone gets a trophy" language and grandstanding preceding....

 Not the slightest argument, but we must then extend discussion to the obvious ills of our society in general....and I'm, as always and very naturally, still losing sleep every night from fears of "spartan" attacks, and more...umm..."warfare" from them. 🙂 I feel we must needs keep focused on what's most "dire" here. 😉

One would reasonably suppose that their "Supreme Commander" and/or all such pathetic village idiots, would've at least have had more properly preconceived spin to now offer....BUT...that would suppose their iluminatii's not nearly half so stupidly arrogant and utterly clueless as they actually are. I'm guessing at least 14-48 hours before these hopeless idiots can even begin to pull some new sales pitch for donations, and naturally, unquestionably "righteous" and utter "victory" outta' their tiny...umm..."minds".  Be the very first to give that "you'se" best shot snapthis?.....or Res?, And prechilled; "you'se" are most welcome to amuse us all with yet another "T Minus" countdown clock...? 😉

It was a trial on the merits... and she "assumed" that USAPA had an existing obligation to use the Nic.  No lie.  She assumed that... Page 10, line 22..

For present purposes, the Court will assume such an obligation existed.
 
I am almost shocked at her ability to weave words and play all sides.  As a judge she has no business assuming the plaintiff's assertion that USAPA had an obligation...  but for the "Present purposes"  uh, this is a trial... but this is a nice excursion into political craft...
 
Obviously, to find USAPA guilty of abandoning an obligation, the court would never be able to implicitly assume USAPA has an obligation merely asserted by the plaintiff.  Judge Wake implicitly assumed USAPA had a Nic obligation and Ironically so did Judge Silver.

I don't think we should interrupt them at this point.....they are in the middle of producing their next video celebrating their victory in court. In fact I think the title will be "Victory In Court" with the music from Victory at Sea!
