I would not count on the appeals court being very clear about anything.  I certainly doubt they will rule on Silver's dicta.  The might rule on Silver's actual ruling, but, if anything, they will probably confuse the entire thing even more with their own dicta and minority opinions (if any).
 
My bet is that they will take 18 months to turn the murky waters completely muddy.

I suppose the Judges at the 9th know the difference between dicta, and ORDER and a JUDGEMENT.  If they comment at all it won't be on dicta, as you point out.
 
 
And I am not so sure the 9th per se' will cause more confusion, after all it was the 9th that explained exactly when the case would be ripe, but it was Judge Silver and the greedy lawyers who ignored the 9th and wasted untold amounts of money and time on an unripe case (again, despite Wake's blunder...).  Judge Wake started the West's money pit but it has been perpetuated by the enthusiasm of Marty Money Maker, Judge Silver, and Liberty Necktie crazies, but let us not forget the company and now the APA.  
 
The 9th (and the SCOTUS, by rejecting to hear the appeal) was the one objective force to provide stability.   If folks would obey the findings of the 9th then money and time would have been saved, but then think of all the jobs that would wither away.  😀

Wilson is going to get educated about what an awesome job USAPA has done fending off the west with labor law. They are going to see what lies ahead if you don't get it like the West legal team and company did not. So far the APA is not very impressive.
That is unless the 9th kicks it right out.

The defendants prevailed.  The company and the APA are pretending there was something in Silver's ORDER that said otherwise.  The court case you are looking for is in DC.  The case in DC will last much longer than your appeal to the 9th, and it will cost the members far less---not even one Liberty Necktie.

How come USAPA has posted the Leospanker Notice of Appeal in the Legal Library, but Cactuspilot.com doesn't even have it posted yet on their own website?  And no meet and great scheduled to celebrate?   What gives?  If I buy a Liberty Necktie can you guys hire a new webmaster that can keep up?

Personally, I'd pissed if I were you that these AOL dudes just got your parole pushed back 18 months. Since the first joint 3 way bid was not planned until early 2016 you are now parked until late 2017 maybe 2018.

The head cheese stated PHL, CLT, LAX and DFW are slated to grow. JFK and PHX flat for the next 3 years.

Enjoy it, you paid for it.

I think they are going to make things perfectly clear. They know the history on the crap about this case that continues to spin around the AZ courts and into their laps again. They seemed to enjoy spanking Wake. Maybe they will put it to rest this time with a real nice write up since the AZ judges can't seem to figure out
labor law.
Bottom line- I personally hope this keeps separate ops for five more years.
