An interesting spin there, which of course, will, without question, keep the entire "rest of the world" quaking in terror of the mighty AOL....? One thing seems certain at least; the whole merger-mania enviornment will, very naturally, necessarily still defer exclusively to the west pilot group's whims...or will it?

Perhaps you really should pull out the crayons...generously assuming you're not using them at present, of course, since they'll be safely free of sharp edges or points...much like your postings. 😉

That does seem to fall somewhat short of a ruling that "The Nic is It!"
Did you have the slightest understanding of what she was ruling on? If it was reduced down to your level of understanding with felt board characters, could you grasp the basic underlying question? She was asked if the company would be liable in a hybrid DFR claim if they were to accept something besides the NIC. Apparently she feels USAPA hasn't gone far enough down the path to make such a decision.

Fortunately they won't be allowed much further down the path if APA takes over. They have no reason to drag out a SLI, so events will wrap up with USAPA looking on in disbelief.

I am interested to read what she actually said, as the I thought the questions before her were whether or not DUI had any responsibility in the event AOL is hypothetically successful in a DFT suit sometime after bargaining is completed and a ratification occurs.

Hate to say it, but you guys got warned years ago about this. USAPA is not beholden to ALPA and the Nic. There is no gun here. Just the one you and others imagine. Time for you to get real about what you want to do going into a merger with AMR. Seeing there are just two lists now. Your choice. None of us are worried about all those empty threats you conjured up because you didn't understand any of this. Not my problem. What are you going to do now??? Nobody is buying any of it anymore just because you guys seem to now disregard two Federal Courts, and a Federal Appeals court. Unbelievable denial.

Read what the 9th said about the Nic and harm before the Westies spin it. They have a very difficult case to make now after 2 Federal Courts ruled and the 9th. Let them try. They may never even have a case. If the entire airline merged DOH, how is that harm if one group attempts a landgrab seniority attempt as does the West with the Nic?

Are you confirming her words today, or are you just reacting to a web board post?

I though the West was hoping Silver would declare the company responsible in a hybrid DFR suit (effectively establishing an injunction requiring the Nic), but if your reaction seems to indicate you believe Silver did not warn the company of any responsibility should they agree to a list other than the Nic, but that USAPA would be solely responsible, and is free to bargain as they see fit.... sounds a lot like the 9th to me, if its true.
