What's "done" (or will be at the POR) is the East-West TA! What's in "effect" and will be the basis of the SLI negotiations and arbitration (if required) going forward, in accordance with the MOU, are the three separate LISTS that you, I and they operate under today. We all voted for and approved this process and we will all live with it.

The MOU does not say that, and FUKU is on pretty dangerous ground, having advertised and sold the MOU as not saying that, then trying to use the West vote as evidence that the West voted for something FUKU specifically said was not in the MOU.

BTW, the TA goes away at POR...um, sort of. There is the clause talking about the time factor of implementation, and that everything can't be immediately changed.

POR-snap shot-what lists are currently in effect? I can tell which one is not in effect and it starts with an "N." But I'm sure you disagree and that's okay. This is America. A round for the room!
 

If FUKU walks into a SLI with anything other than the Nic, you can pretty much be assured that any east and any West pilots retiring in the next 3 years will get royally screwed.

Expect LOA93 wages for the next 3-5 years while the court battles rage, and do not be surprised when the company does not pay retro to those who retire in that time once they are out the door.

The company will say they cannot pay the new wage without the synergies of the merger, and the continued SLI battle will prevent those synergies.

And you can bet the battle will continue...we already can't agree on what the MOU even says. I say it says Nic and AMR, you say it says 3 list, and I am ready willing and able to go to court and make my argument.

In the end of all of this, it will still be the Nic. And, I really do not think it will take 3 years, because the APA is going to shut down FUKU long before they allow a fake union founded on violating it's DFR to rain on their parade.

The west has every intention of torpedoing this merger. Remember to aim ahead of the moving ship, unless it is going backwards!

FUKU will not be a player for SLI talks- they will be long gone by then. And FUKU sheep will be paying for their own court costs and the FUKU sheep will have to start from scratch because the APA will take over the appeal from Silvers case. The FUKU sheep won't own the appeal, APA will

Well there are numerous listS in effect.

There is the east list, the West list, the 3rd list, and the Nic. Are there still flow through listS, I lost track of that?

You are basing your argument on the use of the plural form of the word list in a subparagraph of the MOU. Really weak argument, when that same subparagraph specifically says AT LCC. Meaning nothing will change AT LCC while we are LCC.

Once we are New American, the MOU specifically says via MB.

Nic4us, why are you opining about a situation you say will never happen, the NIC not being the list before M/B? The new wages and retrospective pay are conditional on all the parties voting/signing, the CLT reps agreeing to send out the MOU, and the arrival of the POR. Nothing more. This merger, unlike the last we attempted, is not about synergies, it is about size. Look at the profits last quarter of AMR and LCC, over .5B, and we are entirely separate. Now allow code share, and they have 95% of what they need. RR

Please give me a scenario where USAPA does NOT represent the pilots of US Airways during the entire M/B process? Prechilli, you know better, your comments are just FUD. And as I have said here many times, the moneys in USAPA's treasury do not automatically go to APA or our own pilots. USAPA can still exist without being the bargaining agent, just as LEO does. And again, does anyone remember ALPA refunding any of our dues on exit? I must have missed that check. RR
