Nic4us, why are you opining about a situation you say will never happen, the NIC not being the list before M/B? The new wages and retrospective pay are conditional on all the parties voting/signing, the CLT reps agreeing to send out the MOU, and the arrival of the POR. Nothing more. This merger, unlike the last we attempted, is not about synergies, it is about size. Look at the profits last quarter of AMR and LCC, over .5B, and we are entirely separate. Now allow code share, and they have 95% of what they need. RR

Because FUKU went into Silver's courtroom and said they would never entertain the use of the Nic, or even consider the fact that it happened.

My point is that it is not the West but FUKU that is causing all the problems. I know it will end up being the Nic, but I also know FUKU is determined to throw a monkey wrench into the machine.

Please give me a scenario where USAPA does NOT represent the pilots of US Airways during the entire M/B process? Prechilli, you know better, your comments are just FUD. And as I have said here many times, the moneys in USAPA's treasury do not automatically go to APA or our own pilots. USAPA can still exist without being the bargaining agent, just as LEO does. And again, does anyone remember ALPA refunding any of our dues on exit? I must have missed that check. RR

Dues collected are subject to an accounting of what is germain in the enforcement of the contract.

Exactly how does a post certified FUKU account for germain expenses when they have no contract to enforce?

ALPA dues were subject to the same rules, but neither the east or West MECs had any money to refund.

Okay, how is this for a scenario. The APA is certified as the bargaining agent. FUKU says they still represent the LCC pilots during the SLI process. The West says, NFW, we want our actual agent to represent us, not the former agent.

Now who do you think will win that argument?

USAPA is a National union. As was ALPA. MEC's have no meaning here. We left ALPA and no dues came back our way. Why do you think you will get dues from USAPA? (unless per the CBL they decide to refund them?) RR

I do. I think it will end up being a "hybrid" solution, based on a "snap shot" taken at the POR, of the three lists. It will take into account relative position and category of aircraft, with some method of accommodation for LOS and will incorporate fences and "no bump, no flush language". It will not even remotely resemble the NIC.

I think the West should and probably will have some kind of independent representation at the table for the negotiations and or arbitration called for in the MOU. They will then have the "opportunity" to advocate for use of the NIC in that process and based on the numbers will, most likely, not be successful in that regard.

You think a different arbitrator is going to come up with something other than relative seniority? Other than the Nicolau, a three-way is almost as good for the west.

No, if I had to bet I'd go with slotting by equipment type/pay. I just don't see how going into the process without the Nic affects that.

I think you're right about a 3 way. It's much better for the west than going in previously merged by DOH. It's better for the east than going into it with the Nic. I think we have a solution!
