A friend has been off on O J I for just shy of three years. He recieved a letter from maintenance admin stateinng he must return to work by Oct. 4 or he would be removed from the seniority list and be considered resigned. He returned to work Oct, 1 with restrictions from his Dr. not to work over 4 hours per day and no lifting ,pushing or pulling. He has had several operations on his knee and back and is on several medications for pain and inflamation. Upon returning to work , the manager told him to go home because there was no work he would be able to perform and he had to prove to him what he could do. There are others in the shop who are on restricted duty and go to work every day and collect a full pay check. He has a back fusion that did'nt take and is to have surgery again within the next 6 to 8 weeks. No one seems to be able to tell him what to do. Any opinions ??

If you know a lawyer experienced in this type of discrimination , yes , a number would be appreciated.

Hot damn, on oji for 3 years??? Would he/she not qualify for Long Term Disability with the restraints the doctor put in place?

Ya maybe,but he looses everything after 20 yrs service with the company due to an injury he got on the job.Because our wonderful union AGC's Mr G and Mr F.Let them put this crap in the current contract.If he doesnt come back to work he looses it all.Hey he tried and was sent home.By the way the other guy on light duty is calling his lawyer now he wants to know why there still making him come to work if there is no light duty.... :up: :up: :up:
