Injunction is out

USAPA, if it were a TV show, it would be the smash comedy hit. They have shot themselves so many times in the foot, there are no toes left.

The company has in hand an injunction and a judge that says it is usapa that has violated status quo not US Airways.

Actually, clear, in discussing the points USAPA raised the Judge rejected the "unclean hands" argument. Basically, even if the company was violating the status quo requirement, the union is not entitled to also violate the status quo requirement. He offered no opinion on whether the company had also violated the status quo requirement. At least, that's my reading of the ruling.

Although USAPA has asserted that it cannot be held responsible for the improper acts of
anonymous individuals, this Court concludes that USAPA has ratified, if not authorized, such
acts by knowing about them and failing to take any meaningful action to discourage them. The
connections between the anonymous harassment and USAPA are abundant. For example, the
number of “block hours” flown by US Airways line pilots references in the “Pink Panties” email
is maintained in a restricted portion of US Airways’s Crew Activity Tracking System (CATS)
database, which is only accessible to a limited number of people. Besides select members of US
Airways’s management, there are 17 USAPA members with access to the CATS database.

I am shocked. We had east pilots with unauthorized access to CATS. Where are the calls for investigation and arrests and howls of outrage that their private information has been breached? If I were one of the 17 good usapa union pilots with access to CATS I would be VERY nervous right now. No I do not think that whoever illegally accessed the database with personal information like FFDO and passport number is going to get 6 months off with pay while they sit at home.

The 3 west guys had a file of seniority information but never have access to CATS. Your boys had the keys and access to all of that data. Who do you think is in more danger of losing their job?
 
This ruling is really a bad thing for anyone associated with this company. Any metal gets bent with injuries in the next year or so, and the company is now liable in writing for pushing it's crews to fly fatigued and or with known maintenance issues. Not an easy one to overcome financially or prejudicially.

The company has a PI backing it. USAPA has f'ed you badly. You easties bend metal it's all your fault.

I'm outraged as well. What was it that plump mustachioed hillbilly said at the CLT crew news a few months back regarding crew room cameras and theft?

Congrats ton the west. We forced USAPA to take desperate measures and they backfired.

Looking back, the east has f'ed themselves time and time again with their pension loss, MDA, and LOA 93. Their history has once again come back to haunt them with a little help from AOL and Mike Cleary.
