The deal with APA requires APA to file for single carrier status as soon as practicable, but no later than 6 months after the closing of any transaction. USAPA will be short lived after any merger of LCC and AA.

AAviator: Have you heard about anything other than two lists from the US side as of yet?
 
Funny, all official apa communications say no sli discussions until merger closes, I wonder why?

Your post does illustrate why there will only be two lists, though. Much like the bankruptcy Judge said he didn't care about what happened to AA employees in 2003 when considering to approve AA's 1113 motions, only about today, an arbitrator won't care about mergers that happened in the past and whether to undo those seniority integrations - he'll only care about the seniority integration in a US/AA merger (IF it happens). US has an official, accepted by both the CBA and company at the time it was completed, integrated list and AA has an official list. That's what will be used.

Do the East and West pilots interface on ANYTHING at all presently? No, that is a clear indication the Nicolau list has never been implemented. It cannot be implemented until there is a joint East West contract.That is never going to happen now. So the seniority list that will be used is the East, the West, and AA. You have to have a joint CBA to get the Nicolau, and that is now not going to happen. Therefore, 3 lists.

You, like many of your lying scum sucking buddies, confuse integration of lists with implementation. IF a merger with AA occurs, that will take care of that last little detail called a contract and you'll be powerless to stop it being in the minority...

There has been an "integration" of the seniority lists by the arbitration award of May 2007. There has not been an implementation of that list as all parties are waiting for a joint CBA to complete the implementation. If its a failure of the bargaining agent's DFR (USAPA) to implement the NIC (an I suspect Silver will affirm that in the coming weeks or months) then why would the even newer bargaining agent not be held to the same legal requirement to use the NIC to integrate the pilots into the AA list if it were to reshuffle the US pilots in the US/AA SLI process?

No, I was just relaying what is being said from that camp. The reality is that there are only two lists involved should a transaction occur. NIC and APA's.

Oh yes, one thing.. IF a merger occurs, the terms require the new AA to honor furlough protection for all AA pilots on the property at the time of the transaction. The language further says that the new AA will do its "best" to negotiate similar protection for LCC pilots.

Its on page 8 of the term sheet if you can get your hands on a copy..

I noticed your post from another thread: The USAPA guys are going out of their way to show every AA pilot on their jumpseats what to expect out of a merger with AA. A date of hire seniority list...

Just have them put it in the same file as the paperwork goes after a trip. It will get the proper attention from the aircraft cleaning crew. :lol:
 
I forgot to ask, was it Mickey Mouse that handed USAPA a defeat on LOA93 or was that Robert Siegel? Was it Daffy Duck who handed USAPA a defeat on the status quo lawsuit in NC or was that Robert Siegel? For a guy who you say his opinion doesn't matter he sure seems to take USAPA to the cleaners in federal court or before an appointed arbitrator on matters related to the RLA and collective bargaining agreements don't you think?
